BMLM19930830- BIG MUSKEGO LAKE/BASS BAY PROTECTION & REHABILITATION DISTRICT ANNUAL MEETING - AUGUST 30, 1993 The meeting was called to order at 7:05 P.M. by Mayor De Ange1is. Also present were Commissioners Patterson, Dumke, Sanders, Schneider, Taube, Misko and Woodard and Deputy Commissioners Flancher, Jones, Pi1ak, Keiser and Krause. Commissioner Schneider moved to approve the minutes of the Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual meeting held August 31, 1993. Seconded by Commissioner Taube, motion carried. - Deputy Commissioner Pilak gave an update on the Priority Lakes Watershed Project. He stated that the project has been in existence for about one and one-half years and he briefly described the different agencies that are part of the project; i.e. various counties, governmental bodies, UW-Extension, DNR, Waukesha County Supervisors (32nd & 33rd Districts), LML Association, Wind Lake Management District, Racine County Land Conservation, Dept. of Agricultural & Trade, etc. He summarized a recent report that he had received from the Priority Lakes Watershed Project indicating what needs to be accomplished. The Watershed is approximately forty-one square miles starting at Moorland/National and extending to Racine County; covering three counties (Racine, Milwaukee and Waukesha). The report indicates what type of runoff comes off of the acreage and just exactly what is flowing into the lakes from the tributaries. The report also indicates where to go to correct problems. Farmers and rural septic system users are to be educated with soil erosion practices. A $50,000 grant to Trees on the Move to reduce their erosion and fertilizer run off. A grant for Freedom Square retention ponds; a grant in the Town of Norway commercial site for run off from parking lot. There are regular meetings which all are invited to attend. Deputy Commissioner Pilak introduced Dan Hussel, a DNR representative, who gave an update on Wind Lake EPA Phase II grant - $150,000. Mr. Hussel introduced Jim Jackley, the Project Manager for DNR for Wind Lake & Big Muskego Lake/Bass Bay. An estimated $100,000 of the grant monies is being used to dredge navigation channels and $50,000 to DNR for staffing. The project consists of dealing with Wind Lake's problems, both with the external and internal loading. As Wind Lake receives about 30% of its problems from Big Muskego/Bass Bay, the loading from Big Muskego Lake/Bass Bay must be addressed as part of this project. Extensive evaluating has been done and alternatives are being discussed to come up with a plan acceptable to the District. ,- Mr. Hussel explained that there are actually two separate grants; the Priority Lakes Watershed Grant which is a State run program and a Federal Grant-EPA which is for Wind Lake. -- - - Big Muskgeo Lake/Bass Bay Protection & Rehabilitation District Annual Meeting August 30, 1993 Page 2 Mrs. Collette Klenz stated that she has been in contact with an R. A. Smith representative and they have told her that over the past six months they have obtained evidence that carp are no longer the problem, that there are other enablers in the lake. Mr. Hussel didn't understand how R. A. Smith could claim to have this information but did explain that the DNR has been out on the lake fish-netting and electro-shocking for carp and other fish, but although they didn't come up with tremendous carp, but there were selective areas with tremendous carp. They netted 300 in Bass Bay. Combination of wind and carp could set lake over the edge. They feel that there are quite a few carp in the lake and that is proven by the lack of aquatic vegetation. Mayor gave update on ownership of the Big Muskego Lake Dam. In recent contact with Bill Sturtevant (DNR), the City Engineers and the City Attorney, we are no closer on the transfer of ownership of the dam to the City than a year ago. We are still battling the same issues. The face of the dam under the water has not been checked. Our City Engineers feel that if the dam was properly installed, there would not be any cracking. Possibly an indemnification agreement can be worked out with DNR that if any failure resulted in the face of the Dam, they will hold us harmless. Deputy Commissioner Jeff Keiser spoke on Future Lake Management Planning. The Deputies would like to develop a management plan to go along with the work that Mr. Hussel has been doing. He stated the Deputies would like Lake District members input to see what they think are problems with the lake, and give it to the DNR. He stated that results have been received from the 1991-92 United States Geological Survey on water quality which basically states that the water quality of Big Muskego Lake is very poor and that the water quality of Bass Bay, fair to poor; both lakes are classified as "highly nutrient rich". Algae problems on both lakes. Mr. Keiser indicated that the questionnaire that was sent out with the agenda was done with hopes that they would receive more input from the District members. Dan Hussel reported that a lake-wide dredging project probably would be an unpermitable activity by the DNR. These shallow lakes are not meant to be 10-15' deep. There could be partial dredging for navigable channels and accesses only. Lakes are declining in this area in water quality. Discussion followed on the activities and problems on the lakes in the area. Mr. Hussel indicated that what has to be done is for the Deputy Commissioners and Commissioners to be educated in order to make decisions as to what is best for the lake and development management alternatives in order to move forward with specific projects to improve water quality of Bass Bay and Big Muskego Lake. - ~ .-' Big Muskgeo Lake/Bass Bay Protection & Rehabilitation District Annual Meeting August 30, 1993 Page 3 Mr. Hussel stated that a drawdown would have more significant environmental impacts than solving the water quality problems. You would have to remove at least up to six feet in order not to have sediment stirred up by wind activity in the lake and if the abundance of carp is not addressed, you are still going to have sediment disturbed, you still are going to have no aquatic plants in the lake, no area for spawning. To address the carp population in both lakes, you are talking about approximately $500,000.00 of treatment - no drawdown. The other alternative is to look at ways to prevent the carp to come back so strongly. One way in which that is accomplished is to establish a very healthy native fish population of northerns and bass to feed on the carp which will provide them with limited habitat. Mr. Hussel stated that there could possibly be some partial dredging in Big Muskego Lake for navigation and for cleaning up the shoreline areas, but it would be limited to providing navigational access on the lake. Mr. Hussel felt that he could approach his Bureau Directors asking to spend $180,000.00 to kill the carp in a one-shot deal; put a carp barrier up the creek to keep them from entering into Wind Lake. In order to reduce the fish kill cost, it would be necessary to reduce the volume of water which means a drawdown of Bass Bay and Big Muskego Lake of approximately 3 feet. The fish need to be treated in November when the water is cold and they can get the best effectiveness of the chemicals which means that the drawdown should be started in September, if not a little bit earlier; keeping the lake down all winter long. Mr. Bob Klenz asked what are the alternatives? What else can we do? Possibly we should be letting Big Muskego Lake alone, as long as the residents are opposed to any drawdown, and dredge bays in Bass Bay over next 5 years. Vern Jones discussed updated boundary map and records. Three tier assessment program discussed. On lake - full access; On lake - limited access; Off lake. Because of too many gray areas, two tier systems preferred - On Lake - Off lake, no access. Deputy Commissioner Pilak stated after going through questionnaires to determine projects, he would like to ask membership to allow deputies to investigate further to determine if it's feasible to establish two tier assessment program for future (not 1994). Mayor noted the system can't be enacted tonight to be charged for next year, but that the deputies are looking for direction from the District if they are receptive to a two-tier system of collecting all monies. Bob Klenz moved to authorize the Deputy Commissioners to investigate a two-tier assessment system. Jeff Verburgt seconded, motion carried. Deputy Commissioner Leonard Pilak reviewed the proposed 1994 Budget, as attached. Jeff Verburgt moved to adopt the budget as presented. Vern Jones seconded, motion carried. The dates for the quarterly meetings and 1994 Annual Meeting were reviewed and accepted: Quarterly Meetings: Tuesday, January 25, 1994 Tuesday, March 22, 1994 Tuesday, June 28, 1994 Tuesday, October 25, 1994 Annual Meeting: Monday, August 29, 1994 Leonard Pilak reported on a dredging project on School Section Lake, a lake with similar characteristics. -- Leonard Pilak reported that the bills for the 1994 Assessments would be mailed in November, 1993 with paYment due February 15, 1994. If not paid by November 1, 1994, the delinquent amount would be placed on the 1994 Tax Bill. Bob Klenz moved to add Big Muskgeo Lake/Bass Bay Protection & Rehabilitation District Annual Meeting August 30, 1993 Page 5 - 12% late penalty to the delinquent accounts added to the Tax Bill.
