""""""""11"" BIG MUSKEGO LAKE/BASS BAY PROTECTION & REHABILITATION DISTRICT MINUTES OF THE ANNUAL MEETING HELD AUGUST 29, 1989 The meeting was called to order at 7:06 p.m. by Chairman Wayne Salentine. Also present were Lake District Commissioners Simmons, Dumke, H. Sanders, D. Sanders, and Taube, Deputy Commissioners Tobin, Pilak, Proeber and Oschmann. The Recording Secretary read the Minutes of the Annual Meeting held August 29, 1988. Tony Tobin moved for approval. Mr. Pilak seconded. Motion carried. Mark Andersen and Gary Nelson from the DNR discussed the recent application received from the City of Muskego for a short term drawdown permit and read response from the DNR dated 8/29/89. Gary Nelson stated that approval or denial by September 1, 1989, as requested in the City's letter would not give enough time to go through the normal process that is necessary before approval or denial of an application. There is a mandatory 30 day public hearing notice that has to be given and Mr. Nelson indicated that he felt there would probably be objections which could possibly cause a delay if it went to a contested case hearing. Mr. Robert Klenz, S79 W15979 Sandy Beach Drive, questioned Mr. Nelson on statements in his letter regarding objections from Wind Lake when he felt that if Wind Lake does, in fact, receive at least 80% of their water from Big Muskego Lake, why would Wind Lake object to the District attempting to improve the water quality? Mrs. Kathy Aron of the Wind Lake District stated that Wind Lake has not voiced their objection to any drawdown project, they just have certain concerns they would like addressed such as the time schedule, loose sediment, and anything that could be affected with the passage of that water. They would like the DNR to identify the vast volume of water passing through Big Muskego to Wind Lake and what the effect would be. Mr. Klenz stated that he felt comfortable that the 80% of water Wind Lake is receiving from Big Muskego Lake is very good. Mr. Nelson stated that Wind Lake receives 80% of their water from Big Muskego Lake and if the City undertakes a drawdown project, the effect could reduce the quality of Wind Lake's water or create other situations that might not be agreeable. Mr. Nelson stated that the DNR is not objecting to the proposed drawdown, it is a matter of timing. Concern is that in undertaking the drawdown by concentrating carp, there will be increasing sediment in the water and that water may be very different from the water they would normally get without a drawdown. . Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual Meeting Page 2 - August 29, 1989 Mr. Klenz felt that carp can be controlled during a drawdown and the following year the water clarity could be improved 100% because of the carp eradication. Mr. Nelson agreed that there are definite benefits to a drawdown, but the question on how long it should be needs to be resolved; a short term or long term. He stated that it is imperative that the DNR go through the assessment process before giving permit approvaL Mark Andersen stated that the DNR is supportive of a well-planned drawdown. He felt that Wind Lake has a valid interest since they receive 80% of Big Muskego Lake's water. He stated that no matter how it is proposed, you still have to go through the environmental assessment process which takes approximately one year. He stated that he felt the City is in a fortunate situation as SEWRPC is working on a Water Management Study for Wind Lake and Big Muskego Lake which will address items that will affect the drawdown. . Commissioner H. Sanders stated that you can't determine the actual effects until you have a drawdown and questioned if the DNR has ever done a drawdown with as large a marsh area. Mr. Nelson responded "yes". Kenneth Baranowski, S94 W14268 Ryan Road asked if the study would show what would be the best time of the year to have a drawdown. Mr. Nelson answered that the study would include what would be the best timing and also insure maintenance of flow. Mark Andersen added that it depends on your management goals as to when and how you want to drawdown. The recommended method is to drawdown in the Fall and re-fill the following Fall. but there are other factors involved. Commissioner Taube questioned how many drawdowns have been done. Mark Andersen replied that approximately 30 to 40 a year. Commissioner Taube questioned if all of these had gone through the environmental assessment process and Mark Andersen replied "yes". . Kenneth Jacobs, S102 W16014 Heinrich Drive, stated that he felt strongly that the DNR is attempting to hold up a drawdown on Big Muskego Lake and that he hasn't had lake access because of the bog and sediments. He stated that his access is all weeded in. He also stated that he felt that the project should be given approval and that it should be done at the State's expense and not be assessed to the property owners. . . . Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual Meeting Page 3 - August 29, 1989 Mr. Ian McNutt, S83 W15231 Mystic Drive, questioned if any project for Big Muskego Lake would be conditioned upon there being a lake access on Bass Bay. Mr. Nelson stated that many things will be happening over the next couple of years and that he felt that the questioned access will have to be resolved if the District wants to pursue the maximum amount of grant dollars. Mayor Salentine questioned the DNR representatives what steps the District should now be taking. Gary Nelson stated that the SEWRPC study being done is expected to be completed in the Summer of 1990 and the draft should be ready by September of 1990. Mr. Nelson strongly felt that the results of the SEWRPC study will greatly support any projects contemplated for Big Muskego Lake and will give points of implementation. Mr. Nelson stated that he will be happy to guide the District through the application process. Mr. Robert Klenz moved to reapply for a short-term drawdown to be followed through step-by-step with the DNR. Seconded by Deputy Commissioner Oschmann. Mr. Brent Martins moved to amend motion to include that Sepember 1, 1990 would be the start of the short- term drawdown. Seconded by Mr. Jacobs, motion carried. The amended motion carried unanimously. Mr. Robert Pelzman, a local real estate agent, voiced his concern over the frustration he was feeling from the residents of the Big Muskego Lake area that the DNR had no intention of issuing a permit for any projects on Big Muskego Lake. Mr. Nelson indicated that the permit approval process generally takes at least a year. Mayor Salentine discussed the status of the Big Muskego Lake Dam take-over. He stated that we are waiting for a letter from the Town of Norway stating that they have no objections to the transfer, and several quit claim deeds need to be completed. The Dam should be transferred shortly. Commissioner Dumke updated those present on the status of Schultz Lane. The final easements are being secured and the City is awaiting an approval from the Corp of Engineers to install a culvert. The project will not start until Spring of 1990. Commissioner Dumke updated those present on the status of the Emerald Park Negotiating Committee meetings and reported that the Committee is finalizing another offer to be reviewed. Mayor Salentine explained that the goal of the Committee is to work the . . . He also stated that a 5 mile limitation has been vetoed by Governor Thompson, but that the Governor is now saying that he will support proposed legislation limiting two landfills to a 3rd Class City, with all others under local controL Mayor Salentine gave an update on the amendment to the Sewer Service Area. The Mayor and Chairman of the Public Utilities Committee will be appearing before the MMSD Commissioners to request that approval be given to include Highway 00 & 45 area. This area has already received SEWRPC approval. The 1989 audit was reviewed. Deputy Commissioner Pilak presented the proposed budget. McNut moved to accept the budget as proposed. Deputy Commissioner Tobin seconded the motion. Mr. Ian ELECTION OF DEPUTY COMMISSIONERS Ian McNut nominated Richard Reinke. Janet Reinke nominated Ian McNut. Richard Reinke nominated Dale Galton. Leonard Pilak nominated Les Proeber. Leonard Pilak nominated Jeff Verburgt. Klenz moved that nominations be closed and requested the candidates say a few words. Reinke seconded, carried. Each candidate proceeded to introduce himself. Commissioners D. Sanders and Simmons acted as ballot clerks. The ballots were tallied and the following were elected as Deputy Commissioners, Leonard Pilak, Tony Tobin, Leslie Proeber, Richard Reinke and Ian Mc Nutt. . . . Big Muskego Lake/Bass Bay Protection & Rehabilitation District Annual Meeting Page 5 - August 29, 1989 Discussion returned to the clean up of Big Muskego Lake and Robert Klenz moved to have the Commissioners apply for a dredging permit for Big Muskego Lake to start the process and that any information received will be copied and forwarded to the Deputy Commissioners. Seconded by Craig Lawdanski, motion carried unanimously. Klenz thanked the Commissioners for being in attendance on their "night off" and moved to adjourn at 9:35 P.M.
