MINUTES OF THE ANNUAL MEETING HELD AUGUST 29, 1988
The meeting was called to order at 7:10 p.m. by Chairman Wayne
Salentine. Also present were Lake District Commissioners
Penovich, Patterson, Dumke, Sanders and Repischak, Deputy
Commissioners Tobin, Klenz, Pilak, Proeber and Repischak, and
City Clerk Marenda. The Clerk read the Minutes of the Annual
Meeting held August 31, 1987. Jeff Verburgt moved for
approval. Mr. Proeber seconded. Motion carried.
The status of the turnover of the Big Muskego darn from the State
to the City of Muskego was reviewed. Commissioner Repischak
reported that he has received no contact from the State as to
acquiring the easements from the property owners. He noted that
the leak observed in the darn after installation of the gauges has
been looked at by the State. They feel backfilling near the wall
will solve the problem. He also reported that the debris left at
the site would be removed by the State with the cost to be paid
by the State or the contractor with no charge to the City.
Deputy Commissioner Tobin reported on the carp removal project.
He advised that he had obtained a list from Gordon Priegel of
fifteen contractors with three willing to participate in the
project. He stated that one of the fisheries would perform a
gill net test to see what type and size of fish are in the
lake. If there is a market for the carp, there will be no charge
to the District. Mr. Tobin responded to a question from Dick
Aron of the Wind Lake District stating that the game fish will be
saved. Mr. Aron stated their District finds a local farmer who
takes the fish and tills them in the field. Mr. Proeber noted
that if the water table is too high, the DNR will not permit it.
Deputy Commissioner Proeber reported on the water testing. He
stated that he has had no contact with Steve Fields of the
U.S.G.S. as to the progress of the testing. Commissioner
Repischak stated he has observed the testing agency go out onto
the lake four or five times. He will contact them and request
Mr. Fields to give the District an update on what they are doing.
Deputy Commissioner Tobin stated that the fish stocking would not
be done until the carp have been removed. Deputy Commissioner
Pilak reported that water clarification testing was started on
July 9, 1988 as a self-help program, which involves dropping a
disk into the water and marking comparisons from week to week.
He indicated it would take a couple of years for good results.
The DNR prepares an annual booklet to see how your lake is doing
compared to others.

The Emerald Park Landfill proposal was discussed. Mayor
Salentine advised that we were successful in getting legislation
passed in the Budget Bill, but it was vetoed by the Governor.
Since that time, Emerald Park has submitted a Feasibility Report,
so they are grandfathered in. He advised that he has been
appointed to a legislative siting committee in Madison to draft
landfill legislation language. Emerald Park Siting Committee
member, Ald. Dumke invited the Deputy Commissioners to attend a
negotiating committee meeting to let the Committee know what they
would like included in the negotiating process to provide
safeguards for the future. Mayor Salentine noted that Ruekert &
Mielke has been hired to review the feasibility plan. He also
noted that the Common Council has made the decision to go to a
contested case hearing.
The Commissioners discussed the potential access to Big Muskego
Lake at Schultz Lane. It was noted that as soon as Schultz Lane
is made into a public road, the DNR will take it over as an
access. A lease is being drawn up by Randy Schumacher of the
DNR. It was felt by some that once the DNR has a public access,
they would do more for the lake such as stocking. Deputy
Commissioner Klenz questioned if the City or the Lake District
would be involved if the DNR negotiates a lease. Mayor Salentine
responded that he believed that the City would be responsible for
this access if maintenance is required. Deputy Commissioner
Proeber stated that he thought that if the DNR leases private
property for the access, the City would not be involved. Mayor
Salentine felt that the City should have some involvement there
and asked for a motion to place the access at the end of Schultz
Lane. He stated the City then would pursue the condemnation
process. Deputy Commissioner Tobin moved that Schultz Lane be
pursued as a public access. Deputy Commissioner Proeber
seconded, carried. The Deputies will pursue and ask the Lake
District to authorize. The City should proceed to obtain the
right-of-way. It was asked if this would be a "free" access.
Deputy Commissioner Tobin stated it would be a public access with
at least a ten year lease required by the DNR. He added that a
reasonable fee can be charged for parking. Mayor Salentine noted
that the City is negotiating for property rights to proceed with
this project, along with attempting to obtain an easement for a
drainage way. Commissioner Dumke explained the extent of the
surfacing proposed.
The 1987 audit was reviewed.

Deputy Commissioner Klenz presented the proposed budget and moved
to accept the budget as proposed. Jeff Verburgt seconded the
motion. It was noted that payment of the study on the condition
of Big Muskego Lake on evaluating water quality had not yet been
made. Frank Switala moved to amend the budget to require a $15
assessment. Brent Martins seconded the motion. Motion carried
by a vote of 17 in favor, 0 opposed.
ELECTION OF DEPUTY COMMISSIONERS
Klenz advised that he would be unable to run again due to now
being the Chamber of Commerce president.
Klenz nominated Jeff Verburgt. Tobin seconded the nomination.
Tobin nominated Leslie Proeber. Klenz seconded.
Bob Pelzmann nominated Steve Oschmann. Frank Switala seconded.
Klenz nominated Leonard Pilak. Proeber seconded.
Frank Switala nominated Brent Martins. Martins declined.
Brent Martins nominated Tony Tobin. Klenz seconded.
Frank Switala nominated Richard Reinke. Gene Godlesky seconded.
Frank Switala nominated April Fredrick. Ms. Fredrick declined.
Leslie Proeber nominated Torn Repischak. Leonard Pilak
seconded. Repischak declined due to being a Commissioner.
Repischak nominated Ken Jacobs. Switala seconded.
Klenz moved that nominations be closed and requested the
candidates say a few words. Brent Martins seconded, carried.
Each candidate proceeded to introduce himself. Commissioners
Patterson and Penovich acted as ballot clerks. The ballots were
tallied and the following were elected as Deputy Commissioners,
Jeff Verburgt, Leonard Pilak, Tony Tobin, Leslie Proeber and
Steve Oschmann.
The pros and cons of lake draw down were discussed.

Discussion returned to the motion to pursue public road and
access at Schultz Lane. Klenz stated that he wished to find out
what it would cost before signing any agreement with DNR. What
are the ramifications of public access on that lake? Klenz
believed it should be brought to a vote again. Gregoria Suchy
moved to table. Nicholas Anton seconded. Motion defeated with 2
in favor and 15 opposed. It was noted that the only way to get
grants and aids is to have a public access. Klenz stated he was
not against the access, but felt the District would lose control
to the DNR. Proeber stated that the lease is between the
property owner and the DNR, not with the District. Klenz called
for the question. The motion was clarified that the Lake
District is giving authority to the Deputy Commissiners to bring
the matter to the City for review. The data collected on
pursuing the access will be brought to the quarterly meeting of
Commissioners. Motion carried.
Tobin moved to adjourn at 8:58 p.m.
