BMLM19820823, .e . ., 18 ,~8 BIG WUSKEGO" LAKE/BASS B~Y PROTECTION AND REHADILITATION DISTRICT MINUTES OF ANNUAL MEETING HELD AUGUST 23, 1982 The meeting was called to order at 7:35 P.M. by Chairman W~yne,Salentine. in the lower level of city hall. Also present were Lake D1strlct, . Commissioners Dumke, Nilsson, Tomczyk, Treba, Colburn, Klenz,and Peno~1ct Also present were Deputy Commissioners Brent Marti9, Al Melnen, Cra1g Lawdanski, Larry Erickson and Deputy Committee Chairman, Estel Ellery and City Clerk Charlotte L. Stewart. The Clerk read the minutes of the previous annual meeting held .and a motion was made and seconded to accept the minutes as presented. Chairman Salentine advised the DNR had agreed to release to the city the water quality report prepared by them by October 31, 1982 even though a lake access pOint has not been agreed upon. Unfinished business - Discussion of detachment request of Orlo Zlenski. 891 Wl3253 Boxhorn Dr. Mr. Estel Ellery advised that after considerable discussion and de- liberations the Deputy Commissioners made their recommendation that the commissioners should file an appeal with the courts not to have the Zlensky's detached from the district. Following a lengthy discus- sion as to whether or not the district should hire an attorney and whether or not a petition could or would be presented that would relieve the members of the governing body from continuing on ~commis- sioners of the district and whether or not property owners could be detached from the district H their property is located within the watershed of the lake, the Clerk read the deci~ion of Judge Wollenzien which requested the commissioners to detach Charmain and Orlo Zlenski from the district. Further discussion followed with Mr. Ellery reviewing the steps taken to establish the Big Muskego Lake/Bass Bay District and the necessity of a district in order to receive state and federal aids. He also advised of the steps taken for forming the boundaries of the district. In answer to a question from Mr. David Gardner as to why he wants to be out of the district, Mr. Orlo Zlensky advised that 109 property owners were let out of the district and that he received no benefits from the lake therefore, he felt he'should be detached. Mr. Al Meinen, Deputy Commissioner, described the lake as being an asset to those who like to hunt and fish. Following considerable more discussion, Commissioner Colburn moved to call for the question. Commissioner Klenz moved to detach the Orlo Zlensky property from the district as the Court has ordered and that if detachment is denied it would be considered an appeal to be filed within 45 days as required by law. Seconded by Commissioner. Nilsson. Upon a roll call vote on Commissioner KIenz's motion, Commissioners Colburn, Nilsson, PenoVich, Tomczyk and Treba voted Itaye". Commissioners Klenz and Dumke voted Ilno". The Zlenskys were dà.ached from the district. Consideration of detachment request of Mr. and Mrs. Donald Schreiber Commissioner Klenz moved to deny this request. His motion lost for lack of a second. Again consider~ble discussion took place with several persons in the audience reiterating that they felt it is the responsibili ty of the aldermen a'~d mayor to make decisions based on the recommendations of the deputy commissioners. Other persons spoke as the lake being a benefit to all in that it was a natural habitat for all animals and birds. Still other persons felt rigid rules and regu- lations should be set as to the boundary lines of the district. Commissioner Klenz again moved to deny the request of the Schribers. His motion was seconded by Commissioner Nilsson. Upon a roll call vote Commissioners Klenz, Dumke, Nilsson and 'I'omczyk voted "ayelt. Commissioner Colburn, Penovich and Treba voted "noli. The mo t ion carried. Tha Webers were det~ched from the district. VOUCHER APPROVAL - Commissioner Klenz moved to approve payment of vouchers in the amount of $371.16. Seconded by Convnissioner Nilsson. Upon roll call the motion carried unanimously. Discussion took place by several persons prescnt regarding the boundary lines of the district, should the commissioners (aldermen) be responsible for the district, the city's present negotiations with Milwaukee MetropOlitan Sewage District, etc. Nominations for Deputy Commissioners The following persons Estel Ellery David Gardner Chuck Harris Miriam Simons were nominated from the floor: John Gultch Bret Martins Larry Erickson 1\1 Meinen Following are the results of a paper ballot vote: Estel Ellery 46 Chuck Harris 43 Brent Martins 39 Al Meinen 38 The five persons with the most votes were elected as Deputy Commissioners of the Big Muskego Lake/Bass Bay Protection and Rehabilitation District.
