For additional information or to request this service, contact Muskego City Hall, (262) 679-4100. CITY OF MUSKEGO Unapproved PUBLIC WORKS COMMITTEE MINUTES OF MEETING HELD MONDAY, MARCH 18, 2013 Ald. Neil Borgman called the meeting to order at 6:00 PM. Also present were Ald. Robert Wolfe, Ald. Eileen Madden, and Public Works Director David Simpson. Ald. Borgman led those present in the Pledge of Allegiance. The meeting was noticed in accordance with the Open Meeting Laws on March 15, 2013. APPROVAL OF MINUTES OF FEBRUARY 18, 2013 Ald. Madden moved to approve the minutes of February 18, 2013. Ald. Wolfe seconded. Motion carried 3-0. STATUS OF PROJECTS Director Simpson gave updates on the following projects: Janesville Road Reconstruction – Utilities moving ahead smoothly. Racine Avenue Recreational Trail – Final plans should be ready by next meeting. Annual Road Program – Should have plans together by next meeting. Floodproofing of structure on Saroyan Road – Home on Saroyan experienced some flooding in the past. A grant from the DNR will be used to elevate the home out of the flood zone. The City’s share will be 10-20% of 100,000. There may be a chance to recoup the City’s share from MMSD. UNFINISHED BUSINESS Moorland Dental Center Request for Refund of Sanitary Sewer Charges – Director Simpson explained this item was deferred at last month’s meeting and new information has been received. MMSD has agreed to a refund of $859.36 basing it on the 2nd quarter usage of 33,000 gallons. The Committee agreed that because Dr. Thompson brought the bill to the City’s attention before it was due and because he paid for the water that was used he should not have to pay for sewer that he didn’t use. Ald. Madden moved to follow MMSD and charge sewer usages based on the 2nd quarter billing. Ald. Wolfe seconded. Motion carried 3-0. NEW BUSINESS Discuss Moose Lodge’s request for reduced interest payment related to a deferred sanitary sewer assessment – Director Simpson explained the City received a request by the Moose Lodge for a reduced deferred assessment payout. The original assessment in 1992 was $5,287.10. Currently the assessment, with interest, it is now $13,879.68. Assessments are in place so that a property owner with a large property will not be required to pay a large assessment until the property is divided. The Moose Lodge is offering to pay $6,300 in exchange for the City considering the deferred assessment completely satisfied. Members of the Moose Lodge were present and explained there is a slim likelihood that the Moose Lodge would ever sell or divide the property, but they would like the peace of mind that for future generations this would not remain on their books. After discussion the Committee agreed there should be separate discussion relating to a sunset on deferred assessments. Ald. Madden moved to defer while the Committee looks into the policy. Ald. Wolfe seconded. Motion carried 3-0. Public Works Minutes March 18, 2013 2 Approval of Janesville Road Reconstruction (Lannon to Racine) Stormwater Management Plan – Director Simpson explained this plan requires the construction of a new retention pond near the intersection of Janesville Road and Park Drive. Three outfalls along the project route will be through the retention pond that releases to the lake, an outfall to Pilak Creek, and a storm sewer connection on Lions Park Dr. There will be a minor increase of runoff intensity at Lions Park Drive and zero increase at the creek where there have been flooding issues. Director Simpson noted the State also had to sign off on this project. Ald. Wolfe made a motion to approve the Janesville Road Reconstruction (Lannon to Racine) Stormwater Management Plan. Ald. Madden seconded. Motion carried 3-0. Discuss revised prioritization of recreational trail construction and potential authorization to proceed with consultant engineering assistance for 2014 projects – Director Simpson explained the Park and Recreation Board has completed their discussion of the revised 2014 recreation trail construction plan. This plan includes the addition of the segment of trail along Lannon Drive from Janesville Road to Martin Drive. Staff is requesting assistance from a consulting engineer for the survey and design of the Lannon Drive segment. Hardtke Drive and Woods Road from Racine Avenue to Plum Creek are also scheduled for 2014 and will utilize in house staff for survey and design. Ald. Madden expressed concern over the Durham Drive/Hwy 36 trail being put off while new projects are added. Ald. Madden stated residents in this area need a trail and are not happy. A resident of Champions Village was in the audience and explained they have no place to walk or ride their bikes unless they take the path to Wind Lake or ride on “OO”, which isn’t safe. Ald. Soltysiak was also present and explained at the Park & Recreation meeting they used density and which areas would get the most use as the rationale behind making these decisions. Ald. Madden requested this be sent back to the Park and Recreation Board and residents be invited to attend. Ald. Madden made a motion to deny the request to hire a consultant for the survey and design of the Lannon Drive trail segment. Ald. Borgman seconded. Motion carried 3-0. Staff was directed to request this item be placed on the next Park and Recreation Board meeting. Respectfully Submitted, Kellie McMullen Recording Secretary CITY OF MUSKEGO Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Discuss drainage issue at W174 S6802 East Drive Date: April 12, 2013 The homeowner of W174 S6802 East Drive has expressed great concern related to storm water runoff coming from City owned conservation land onto their property. The attached construction drawing from 1991 shows how this issue was addressed when it was first brought to the City’s attention. There is a storm inlet and berm system that was designed and installed to collect runoff from the conservation land. This inlet has become clogged during past rain events and the water then spills over the berm and down the property line between the City owned land and W174 S6802 East Drive. These pictures show how the water flows when the inlet becomes clogged or overwhelmed. There are two options as I see it to potentially resolve this issue. The first would be to install an end section out of the existing field inlet to prevent the existing inlet from becoming clogged with leaves. The second option would be to install the end section and also construct an overland relief path (swale) down the City’s property to East Drive. If the second option were chosen, many mature growth trees would need to be removed from the City’s conservation land. If this option is chosen, I think that it would be prudent to refer this issue for discussion at the Conservation Commission as this is deemed conservation land. One of those problem areas were homes near the intersection of Cornell and Catalina. The City expedited a work plan to install a relief sewer that would reduce the likelihood of future flooding of the intersection. The project was budgeted, designed, and installed by the fall of 2011. A resident along the north side of Cornell Drive had also requested that the City look into the possibility of installing a storm sewer through side yards from Cornell Drive north to the Tess Corners Elementary School Property to reduce the amount of overland drainage through the side yards. During initial design, the Public Works Committee, on March 28th, 2011 (minutes and memo attached), voted to add this section of pipe to the project for an estimated cost of $22,500 (not including easements or grading on school property). Design progressed and more detailed cost estimates were produced by GRAEF. The project was severely over budget and the decision was made by the Public Works Committee, on July 28th, 2011 (minutes and memo attached), to reroute the main pipe and remove the section of pipe between the homes to the north of Cornell Drive. Alderman Harenda has asked that this item be added to the agenda for reconsideration. Given that the City’s project met its goal of providing protection against flooding I do not feel that we should address this issue further. Perhaps the school district would be willing to discuss this further with the homeowners as this is runoff from school owned land. Recommendation for Action: Recommend not moving forward with any further storm sewer in this area. NB-#4 CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: Engineering Department, David Simpson, P.E., City Engineer Subject: Catalina Storm Sewer Design- Cost vs. Benefit Matrix Date: March 24, 2011 GRAEF has been working on the design of the Catalina Storm Sewer Project since the project was awarded. Some work was on hold until enough snow had melted to obtain good survey data. GRAEF has completed the cost/benefit analysis for the design (see attached sheets). Two analyses were completed, specifically, one for the 100 year event, and one for the July 22, 2011 event (which was greater than the 100 year event). There are two types of pipe shown, Reinforce Concrete Pipe (RCP) and High Density Polyethylene (HDPE). The City has historically utilized RCP on projects, however, HDPE has now become accepted industry wide and would be a good fit for this job. The matrix shows the different levels of protection based on the different pipe sizes and storm events. Also, as requested, a cost estimate was put together to add a storm sewer between the homes on the north side of Cornell in order to capture storm water on the school site as opposed to it running overland. The added cost for this (assuming the residents voluntarily give an easement to the City) would be approximately $22,500.00. The need for this pipe segment can be discussed further. Recommendation for Action: Recommend designing the project with a 48” HDPE pipe. Direct staff regarding the additional pipe segment to the north. Also present were Aldermen Neil Borgman and Kert Harenda, City Engineer David Simpson, Public Utilities Superintendent Scott Kloskowski, and Public Works Superintendent Wayne Delikat Ald. Fiedler led those present in the Pledge of Allegiance. The meeting was noticed in accordance with the Open Meeting Law on March 24, 2011. APPROVAL OF MINUTES OF FEBRUARY 21, 2011 Ald. STAFF REPORTS None STATUS OF PROJECTS Janesville Road Reconstruction (Moorland to Racine) – City Engineer Simpson stated nothing new. Durham Drive Reconstruction & Sanitary Sewer Project – City Engineer Simpson stated we would discuss later. McShane Pump Station Upgrade – Public Utilities Superintendent Kloskowski advised they had PreCon meeting and ready to roll along. Ryan Road Sanitary Sewer Relay – Public Utilities Superintendent Kloskowski stated same thing – we had PreCon and will be starting on the 4th. Putting up signs to let people know road is going to be closed and in a week it will be done. Storm Water Mitigation Studies (Fountainwood Subdivision, Luehring Drive, & Circle Drive) – City Engineer Simpson advised Fountainwood Subdivision still going back and forth with the district with funding. They have an internal meeting tomorrow and promised they would push to have an answer. Luehring Drive is moving forward. Letters were sent to residents (9) we need temporary easements from. Residents expressed interest in doing project later half of the summer. Circle Drive we envision the PPII Reduction program funding being used after we get off base with this Plan 1 will move forward. Private Property Infiltration & Inflow (PPII) Reduction Plan – Discussed in New Business. Private Property Sanitary Sewer Back Up Prevention Policy - Discussed in New Business. UNFINISHED BUSINESS None NEW BUSINESS 2 Presentation and Discussion of report entitled “Results of Water Stage Monitoring for Big Muskego Lake South Inlet Ditch” - City Engineer Simpson stated the City of Muskego commissioned a study as a result of receiving complaints along a tributary to Big Muskego Lake that begins at Union Church Drive and empties into Big Muskego Lake. Ken Ward from R&M did a presentation of findings (about two years), discussed and answered questions from residents. Ald. Borgman made a motion to direct staff to install the recommended culvert and continue staff monitoring where possible. Ald. Harenda seconded. Motion carried 3-0. Review request from Mike Birkley regarding required improvements to Summertime and Laura Lane – City Engineer Simpson advised Mike Birkley submitted a request for having a gravel road within public right-of-way in conjunction with a proposed land division. He made a similar request in November 2009, only contemplating one additional lot at the end of Laura Lane without dedicating additional right-of-way. At this time he is contemplating two additional lots on the end of Laura Lane and three additional onto Summertime Lane. As with any land division, we are charged with ensuring that public improvements are adequate to serve said division. Had discussion with Mr.Birkley, Laura Lane residents and Committee. Ald. Borgman made a motion for Summertime recommending to require full City street improvements from the intersection of Schultz to the end of Lot 4 with a cul-de- sac that’s adequate for emergency vehicles. Ald. Harenda seconded. Amendment to motion.Ald. Borgman made a motion for Summertime L ane recommending to require full City street improvements from Schultz Lane to the end of Lot 4 with a cul-de-sac and the decision of curb and gutter or ditches left to staff. Seconded by Ald. Harenda. Motion carried 3-0. Ald. Borgman made a motion to improve Laura Lane to require full roadway improvements at the Developer’s cost to City standards from Shultz Lane to the terminus of the roadway. Ald. Harenda seconded. Approval of work plan development and policy for Private Property Infiltration & Inflow Reduction Program and Private Property Sanitary Sewer Back Up Prevention Policy – City Engineer Simpson advised that MMSD has approved the policy document necessary to complete the City’s PPII Reduction and Sanitary Sewer Back Up Prevention Plans. Work Plan #1, an agreement to provide services by Brown and Caldwell through the MMSD’s PPII Reduction Program funds is approved through the district. City staff would like to finalize the policy statements with MMSD and begin mailing letters to the “at-risk” properties. The City will pay for a portion of the backflow preventer’s cost. Ald. Borgman made a motion to approve the scope as outlined in the attachment and direct staff to mail letters to “at-risk” properties as soon as possible. Ald. Harenda seconded. Motion carried 3-0. Review cost vs. benefit matrix for Catalina Storm Sewer Project design – City Engineer Simpson stated GRAEF has been working on the design of the Catalina Storm Sewer Project since the project was awarded. There were three homes with flooding. GRAEF has completed two cost/benefit analyses for the design – one for the 100-year event and one for the July 22, 2011 event. There are two types of pipe – Reinforce Concrete Pipe (RCP) and High Density Polyethylene (HDPE). HDPE has become accepted industry wide and would be a good fit for this job. For no ponding in the street during July 22 event you would have to go with the 48” sewer, if you want one foot of ponding in the street you would go with the 42”. Also a cost estimate was put together to add a storm sewer between the homes on the north side of Cornell in order to capture storm water on the school site as opposed to it running overland. The added cost for the would be approximately $22,500.00. Ald. Borgman made a motion to recommend designing the project with a 48” HDPE pipe and add the additional pipe segment to the north. Seconded by Ald. Harenda. Motion carried 3-0. 3 Request to vacate a portion of College Court right-of-way – City Engineer stated Veolia at the end of College Court got a variance for the building they put up and wish to make it conforming. We suggested they do it through this process requesting a vacation of right-of- way and moving the cul-de-sac north. There is sanitary sewer and storm water ditches located in the existing right-of-way so easements would be required. Ald. Harenda made a motion to recommend vacating of a portion of the College Court right-of-way with all costs related to said vacation process being paid for by the petitioner. Seconded by Ald. Borgman. Motion carried 3-0. Review Durham Drive Reconstruction bid amount and pertinent effects on assessment roll for the Durham Drive Sanitary Sewer project – City Engineer Simpson advised the City has levied special assessments against certain properties that will benefit from the extension of sanitary sewers as part of the Durham Drive Reconstruction project. These assessments were levied based on an Engineer’s Estimate prior to actual bidding of the project. Bids were opened March 15th and resulted in actual bid amounts (for the sanitary sewer portion only) higher than the Engineer’s Estimate used to complete the current assessment roll. Bids were substantially higher than estimated because of extensive dewatering that the Contractors feel will be necessary to construct this project. The Committee must consider and recommend these one of these options – 1. City Sewer Utility would pay for additional costs which would amount to approximately $236,263.54. 2. Revise the special assessment roll to require the Sewer Utility pay for the per unit cost differential which would require a Public Hearing. 3. Revise the special assessment roll to require the residents to pay for the entire cost difference between the original estimate and Engineer’s Estimate. 4. Cancel the sanitary sewer extension project. Ald. Borgman made a motion recommending Alternative 2 revising the based on the assessed amounts presented and to schedule a Public Hearing as soon as we possibly can do it. Ald. Fiedler seconded. Motion carried 3-0. Recommendation of award of bid for the Durham Drive Reconstruction Project – City Engineer Simpson stated the project’s low bid was below the original Engineer’s Estimate and well within budget for this project. The low bid was received for C.W. Purpero. Ald. Borgman made a motion to recommend award of bid to C.W. Purpero in the amount of $2,757,316.70. Ald. Harenda seconded. Motion carried 3-0. Recommendation for approval of contract management services for the Durham Drive Reconstruction Project – City Engineer Simpson advised he asked five consulting engineering firms to submit proposals for construction management services of the Durham Drive Reconstruction. I asked for resumes of key individuals that would be involved with the project, and to provide a lump sum fee for the completion of as-built record drawings, and a project web-page. A major component of this review is based on past successful experience with City of Muskego projects and knowledge of City specifications. Based on all of the factors reviewed I recommend Foth. Ald. Borgman made a motion to recommend approval of construction management services by Foth. Seconded by Ald. Harenda. Motion carried 3-0. Recommendation of purchase of Department of Public Works Patrol Truck – Public Works Superintendent Delikat stated he would recommend taking the low bid of the bid summary for the plow truck which would be Lakeside International LLC. Ald. Borgman made a motion recommending to approve the plow truck purchase. Ald. Harenda seconded. Motion carried 3-0. 4 Recommendation of purchase of Department of Public Works Vacuum Truck – Public Works Superintendent Delikat stated after budget time vendor brought out a truck and it would not even pick up a pile of leaves. The original route was planned to go through Kurth Park and would have allowed the option of adding a retention pond in the future. As design was nearing completion, we found that the original cost estimate of $250,000 was going to be exceeded by more than $250,000. Around this same time, State law requiring Cities to reduce their TSS by 40% was rescinded. This gave us the opportunity to look into other options. GRAEF was able, at their own cost, to resize and relocate the proposed route straight down Cornell Drive (see attached exhibit). We also eliminated the extra pipe between the homes north or Cornell (as it is not necessary to reduce flooding) and reduced the size of the relief pipe by calibrating the flood model to the July 22, 2011 rain event. We also intend on keeping the existing pipe and making any spot repairs as needed. The attached cost estimates reflect two options. The first is a 21” pipe that will protect against the July 22, 2011 rain event for an estimated cost of $193,000. The second is a 24” pipe that will provide added protection for a cost of $214,000. Also attached is a schedule that GRAEF has put together showing that we can still build this project this year. There will be additional cost for the redesign in the amount of $11,900 (see attached). STAFF REPORTS None STATUS OF PROJECTS Janesville Road Reconstruction (Moorland to Racine) – City Engineer Simpson stated met with WE Energies Electric and Time Warner representatives last week and moving forward quite quickly. Plans to bury by October, 2011. Durham Drive Reconstruction & Sanitary Sewer Project – City Engineer Simpson advised sanitary portion of project is complete. Water mains will be relocated, finishing up water laterals today. McShane Pump Station Upgrade – Bypass pump is done per Public Utilities Superintendent Kloskowski. Storm Water Studies (Luehring Drive, Circle Drive, and Catalina Drive) – City Engineer Simpson gave a status update. Luehring Drive and Catalina will talk about in New Business. Circle Drive have a scheduled meeting with MMSD in a few weeks. PPII Reduction & Sanitary Sewer Backup Prevention Programs – City Engineer Simpson stated letters went out a week and half ago to 100 residents that are in 1st phase, and have received about 25 responses. Consultant working with us will be scheduling those inspections very soon. Recommend Award of Bid for Luehring & Hillview Drive Drainage Project – City Engineer Simpson stated bids were received July 7, 2011, for the Luehring and Hillview Drives Drainage Improvements and Road Reconstruction Project. We received six bids. Musson Brothers was the low bidder. The low bid falls within our budgeted scope of which we estimated $250,000, which also includes inspection and design work. Musson Brothers is a large company and do State work. They have plenty of equipment and plenty of experience for this type of job. Ald. Werner made a motion to award the Luehring Drive and Hillview Drive Drainage and Road Project to Musson Brothers. Seconded by Ald. Soltysiak. Motion carried 3-0. Recommend Award of Bid for 2011 Road Improvement Program – City Engineer Simpson advised bids were opened July 14, 2011 for the 2011 Road Improvement Program. We had three bidders. Bids came in very low. Payne & Dolan was $477,890. The actual budget was $625,000, which includes inspection and design work. Most of design work was done in house. We will have extra money in this years budget to add additional road work. Ald. Soltysiak made a motion to award the 2011 Road Improvement program to Payne & Dolan and use staff discretion to bring the next on the list road projects with the balance of the funds. Ald. Werner seconded. Motion carried 3-0. Discuss City’s Position on the Tess Corners Creek Pond Project – The Mayor received a letter from the City of New Berlin dated June 14, 2011. It discusses the Tess Corners Creek Pond project that was originally discussed in 2000 per City Engineer Simpson. This project was intended to be built in New Berlin and serve both New Berlin and Muskego. Essentially the pond would act as water quality pond for New Berlin and water quantity pond for the City of Muskego. This would reduce the storm event flows by approximately 37%. Back then a grant was given, but expired and was revoked by the DNR. New Berlin backed out in 2004. They said they would keep it in their plan and developers would build a plan in the future. They thought by 2008 it would be part of a development area. Nothing has developed. New Berlin is now saying that the reduction in total suspended solids is not cost effective for them and that they do not feel that moving forward with the project is cost effective for that reason. It would be a very costly investment, but one that the City may wish to make at some point. Recommend staff to write a letter to New Berlin regarding considering mutually beneficial projects. Jeanne Struck Recording Secretary Page 1 of 1 CITY OF MUSKEGO Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Request to amend Linnie Lac sewer service Inter-Municipal agreement with New Berlin Date: April 12, 2013 The City of Muskego and the City of New Berlin entered into an agreement to provide a limited number of New Berlin residents with a limited number of sanitary sewer services. The original agreement was entered into in 1974, with the last amendment being approved November 30th, 2009 (see attached agreement). In this agreement, it specifically states that no additional connections are to be allowed within the area referred to as exhibit A (see attached). The City of New Berlin is requesting that the City of Muskego consider one additional connection to a parcel within this area (see attached letter forwarded by New Berlin staff). Should the City of Muskego tentatively approve this request, the existing agreement must be amended and approved by the Common Council. Staff feels that the addition of this connection in this area would promote the overall environmental health of this area. Given that these lands drain into Muskego, it is in the best interests of the residents of Muskego to eliminate or prevent the installation of private treatment systems. Given these facts, we recommend working with New Berlin toward an amendment to the current agreement. In order to ensure that the agreement is written properly, the City of Muskego will need to expend monies to have the City Attorney involved in this process. Given that the City of New Berlin has offered to reimburse us for all legal fees, I would recommend that we send the draft agreement to the City Attorney for comments and bring forward a final version (with Attorney approval) to Common Council for final approval. Recommendation for Action by Committee: Recommend approval of the “Agreement to Amend the Linnie Lac Sanitary Sewer District By and Between The City of Muskego and the City of New Berlin” pending approval by the City Attorney. CITY OF MUSKEGO Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Review vision corner encroachment request for monument sign for a new commercial building at the Northeast corner of Moorland and Janesville. Date: April 12, 2013 Muskego Retail Center is requesting that their proposed monument sign be located within the City’s standard vision setback area. This area is described and shown on the attached code section and sketch of the proposed sign location. Given the geometrics of this intersection (signalized four land divided in all directions), there is no need to enforce the vision corner setback in this situation. Per City code, Vision Setback Area variations may be allowed by the Public Works Committee. Recommendation: Allow placement of the monument sign in the vision setback area as shown on the attached sketch. CITY OF MUSKEGO Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Discuss revised Prioritization of Recreational Trail Construction and potential authorization to proceed with Waukesha County engineering assistance for CTH OO recreational trail design Date: April 12, 2013 The Parks and Recreation Board has completed their discussion of the attached revised recreational trail construction plan. This plan is meant to be a guideline for future trail design and construction efforts. The plan for 2014 construction includes the segment of trail along CTH “OO” (North Cape Road) from Durham Drive to STH 36 (Loomis). This plan has been put together with the idea that staff will rely on assistance from consulting engineers for many of these sections of pathways. I would like to utilize Waukesha County for survey and design of the CTH “OO” segment. I would like to move ahead with a design agreement with the County that would be taken to a future Finance Committee and Common Council Meetings for approval as the design dollars are not currently in the 2013 budget. However, by allowing design to start now, we will have enough time to utilize County staff and ensure proper communication with the residents throughout the process. I am proposing we utilize in house staff for the survey and design of the Woods Road and Hardtke Drive segments. Hardtke Drive will be constructed in conjunction with the road’s rehabilitation while the Woods Road and CTH “OO” segments will be stand- alone projects. Recommendation for Action: Approve moving forward with a design agreement with Waukesha County for the survey and design of the CTH “OO” trail segment which will be brought before Finance and Council for final approvals for a 2013 expenditure.
