MINUTES OF MEETING HELD MONDAY, DECEMBER 17, 2012
Ald. Neil Borgman called the meeting to order at 6:00 PM. Also present were Ald. Robert
Wolfe, Ald. Eileen Madden, and Public Works Director David Simpson.
Guest Ed Hinrichs, Waukesha County.
Ald. Borgman led those present in the Pledge of Allegiance.
The meeting was noticed in accordance with the Open Meeting Laws on December 14,
2012.
APPROVAL OF MINUTES OF NOVEMBER 19, 2012
Ald. Madden moved to approve the minutes of November 19, 2012. Seconded by Ald.
Wolfe. Motion carried 3-0.
STAFF REPORTS

STATUS OF PROJECTS
Director Simpson gave updates on the following projects:
Janesville Road Reconstruction – Coming along. Permanent traffic signals should be in a
couple of weeks.
Pioneer Drive Reconstruction – Complete.
Tess Corners Reconstruction – Complete. Just need grass to grow.
Racine Avenue Recreational Trail – Working with County. Have first draft plans put
together. I will be working with a consultant shortly to work on floodplain and wetland
crossing. Moving along.

Discuss Janesville Road (CTHL) Phase 2 Project Design Elements that do not Meet
Optimal Design Guidelines – Ed Hinrichs, Waukesha County, advised this is
something they do for a design study report on all projects. They try to meet current
design standards. This project is through the DOT so it’s even more intensive and
we try to meet these goals the best we can. There are a couple elements the
County wanted to make the City aware of that we are not going to meet optimal
design. The first one is the Lannon Drive intersection angle, they wanted it closer to
70 degrees, it’s 63-1/2 right now. In order to make it more optimal we would have
had to take more right of way, properties, and the banks. It’s been that way. It
should be okay. The second issue he stated is they are really starting to enforce the

sidewalk and crosswalk designs to accommodate physically challenged pedestrians,
requiring a two percent grade of the roadway to the crosswalk. To fix the issue
would require flattening the intersections with crosswalks, but that could cause a
noticeable dip in the road as drivers proceed through. He felt we would be given an
exception from the state for these items because of how long the design plans have
been out there. He was confident that no major changes would need to be made.
No action required.
Review Request for Sanitary Sewer Service Area Extension – Davis CSM – Woods
Road – Director Simpson stated previously it was approved for a two lot land division
on Woods Road, which requires that Lot #1 of the land division be connected to the
City’s sanitary sewer system. To accomplish this requirement the City must first
amend the current Sanitary Sewer Service Area (SSSA) to include the lands within
the new Lot #1 boundaries. The first step related to this amendment is made by
requesting said amendment from the Southeast Wisconsin Regional Planning
Commission (SEWRPC). He advised we make a request for a Sanitary Sewer
Service Area boundary amendment to SEWRPC for these lands. Ald. Wolfe made
a motion to make the request. Seconded by Ald. Madden. Motion carried 3-0.

Subject: Discuss Moorland Dental Center request for refund of sanitary sewer
charges

The attached was received from Moorland Road Dental Center in regard to a request
for a refund for their sanitary sewer bill for the third quarter of 2012. Moorland Dental
Center is billed for their sanitary sewer usage based on actual water consumption (as all
commercial properties), which is determined by utilizing the water meter which tells
the City how much water was utilized. Some commercial properties elect to have what
we call a “deduct meter” installed on all of their plumbing that will be used for outside
irrigation so that they will not be charged for sanitary sewer service from water utilized
in the irrigation process.
Moorland Dental Center did not elect to install a deduct meter, therefore, they are billed
for all water used regardless of whether it is utilized for irrigation. As stated in the
letter, a deduct meter was not installed at the time of irrigation installation, however,
they plan to install one.
The third quarter bill for sewer usage in 2012 is $3,895.32 which is substantially more
than their normal quarterly bill (see attached spreadsheet). If we were to consider a
refund, we would have to recognize that any commercial building without a deduct
meter would have the same right to come forward and request a refund. This could be a
precedent setting decision that could cost the sewer utility much more than the cost of a
partial refund in this one case. Unfortunately, there is no way to quantify how much
water was actually utilized for irrigation and no way to know if the high water use
wasn’t actually from another issue such as a plumbing leak or overuse.
Recommendation for Action:
Deny the request for a refund for sanitary sewer usage fees by Moorland Dental
Center.

Subject: Belle Chasse Phase II- Discussion of Mystic Drive Realignment at Woods
Road

The second phase of the Belle Chasse subdivision is tentatively scheduled to move
into construction this Spring. Before that can begin a development agreement
must be approved by the Common Council. As part of that agreement any off site
improvements that the City believes to be necessary for the development must be
accounted for.
In the case of this Phase of the Belle Chasse subdivision, the planned intersection
improvement at Mystic Drive and Woods Road will be affected by the
introduction of new development to Mystic Drive.
I have calculated the percentage of impact to the intersection based on an assumed
loading of 50% of traffic from Belle Chasse with the other 50% utilizing Durham
Drive. Knowing that new Belle Chasse traffic will account for approximately 22%
of all traffic at the Mystic Drive intersection, it would be fair to ask the Developer
to contribute this percentage to the intersection realignment.
I have estimated the cost of intersection realignment at $60,000, therefore, the
developer’s share would be $13,200.
Recommendation for Action by Council:
Include a provision for a lump sum payment of $13,200 to the City in the
developer’s agreement for Belle Chasse Phase II for the future intersection
improvement of Mystic Drive and Woods Road.

Conveyance of Rights in Valley Drive related to existing City owned
Utilities in Valley Drive

Waukesha County has requested that the City of Muskego convey existing City
rights in land that exist in the Valley Drive right-of-way, just south of Janesville
Road.
The Valley Drive right-of-way has come into question as to its official dedication
during the title search process. Because of this, the County has decided to
purchase the Valley Drive right-of-way (as shown on the attachment) as if it were
existing private land. As the County purchases this land, the assumed easement
rights that we own on these lands need to be released so that the new right-of-way
does not have easement encumbrances. City owned water main and sanitary
sewer are within this newly purchased area.
The attached documents show the area of requested easement release and
documents for the conveyance of rights in land for the area shown. As this is a
mutually beneficial project, the County is requesting a no cost conveyance per the
attached documents.
Recommendation for Action by Council:
Approve conveyance of rights in land for the Janesville Road Reconstruction
project per the attached documents within Valley Drive.

The intersection of Woods Road and Moorland Road is currently a four way stop
controlled intersection. During morning and afternoon peak hour traffic the
intersection is experiencing high wait times. I was asked by Alderman Wolfe to
explore moving an alternatives analysis into this year’s projects and have
determined that the cost to do so would be approximately $12K-$15K. For this
price, the following scope could be accomplished:
Data Collection
12-hour intersection count
Crash data, 5-years
Intersection geometrics
20-year traffic projections
Signal warrant analysis
Comparative analysis of stop signs, signal and roundabout for the following elements
Traffic operations
Safety
Very rough impacts (relatively generic, but will id potential red flags)
Ped/bike accommodations
Written tech memo summary
Conceptual level designs could be created for three design alternatives
The designs could be used to refine the right-of-way impacts and costs for the three alternatives
Should the Committee wish to move ahead with this project I can utilize funds from
the 2013 Road Program and proceed with enlisting the assistance of a consultant to
complete the project as described in the scope above or as modified by the
Committee.
Recommendation for Action:
Discuss the warrants of this study and direct staff to proceed as you see fit.
