MINUTES OF MEETING HELD MONDAY, JUNE 18, 2012
Ald. Neil Borgman called the meeting to order at 6:00 PM. Also present were Ald. Eileen
Madden and Public Works Director David Simpson. Ald. Robert Wolfe absent.
Ald. Borgman led those present in the Pledge of Allegiance.
The meeting was noticed in accordance with the Open Meeting Law on June 15, 2012.
APPROVAL OF MINUTES OF MAY 2, 2012
Ald. Madden moved to approve the minutes of May 2, 2012. Seconded by Ald. Borgman.
Motion carried 2-0.
STAFF REPORTS
None
STATUS OF PROJECTS
Director Simpson gave updates on the following projects:
Janesville Road Reconstruction (Moorland to Lannon) – Everything is going well. Signs are
up and letters went out to residents within a half mile radius regarding closure Friday, June
22, at 7:00 PM until Monday, June, 25, at 7:00 AM, to replace the box culvert.
Pioneer Drive Reconstruction – Awarded the contract. The contractor has some signs up
warning the road will be closed soon. Utilities have been working to keep ahead of the
contractor.
Tess Corners Reconstruction – Tess Corners was awarded last week. I anticipate mid to
late July they will start.
Woods Road Recreational Trail – Woods Road is going well. The Engineering Tech has
been on site almost full time making sure all the right trees are being cut down. Have not
had any problems.
PPII Reduction & Sanitary Sewer Backup Prevention Programs – No discussion.

Discuss Request from Lake Brittany Homeowners Association (LBHA) for the City of
Muskego to Make a Tapered Cut into the Concrete Curb on Oxford Court - City
Engineer Simpson stated the Lake Brittany Homeowners Association submitted a request to
remove a small portion of the curb that is part of the landscape island within the Oxford
Court right-of-way. By removing the curb’s vertical face, it allows easier access for lawn
care equipment. It was discussed with Committee and residents. Director Simpson

recommended approving the requested curb opening request and charging expenses for the
construction to the LBHA. Ald. Borgman made a motion to approve the curb opening
request as presented to us. Ald. Madden seconded. Motion carried 2-0.
Discuss Request to Modify Previously Approved Public Works Drainage Plan Near S69
W17548 Redman Drive (Redman & Lake) – City Engineer Simpson advised a drainage
concern at and near S69 W17549 Redman Drive was discussed at the February 20, 2012,
Public Works Meeting and a drainage plan was approved to help alleviate the problem. The
homeowner has requested the City reconsider the issue and move the proposed drainage
swale further from his garage so he can utilize the City right-of-way. Because a specific plan
was approved, this request is being brought back to Committee for reconsideration.
Recommendation was to direct staff as to how much area within the existing right-of-way the
Committee would like to have remain as usable area to the homeowner so that a redesign
can be completed. Ald. Borgman made a motion to move swale further from his garage.
Seconded by Ald. Madden. Motion carried 2-0.
Recommend Approval of the Compliance Maintenance Annual Report (CMAR) for 2011 -
City Engineer Simpson stated one of our responsibilities in the operation of the City’s
Sanitary Sewer Conveyance System comes from the WDNR. They require an annual report
titled “Compliance Maintenance Annual Report” (CMAR). Part of the report is a requirement
to have a resolution in order to ensure that elected officials are aware of the current state of
the system by sharing the CMAR and ensuring adequate funding is available to the Utility.
Ald. Madden made a motion recommending to approve resolution. Ald. Borgman seconded.
Motion carried 2-0.

Subject: Sanitary and water main connection requirements for a preliminary land
division on Woods Road currently addressed as W200 S8609 Woods
Road (Davis CSM).
Date: August 24, 2012
A preliminary Certified Survey Map has been submitted to the City and a the owner
has requested that the City consider allowing private treatment systems and private
wells on all three of the lots that will be created by this land division. Lot #2 has an
existing home located on it with private systems already in use. Lots 1 & 3 will be
new vacant lots (see attached).
Sanitary Connections. Because lot #1 is in close proximately to an existing grinder
line sanitary system, I recommend requiring lot #1 connect to the sanitary system.
This must be accomplished through a Sanitary Sewer Boundary amendment and
extension of the existing low pressure line to the lot line of lot #1. Lots 2 & 3 are a
great distance from existing facilities, therefore, connection may be overly
burdensome.
Water Connections. With lot #1 having water directly in front of the frontage, our
code requires connection of the new building. Per our plumbing code, lot #3 may
require connection if it is determined to be within a “Special Well Casing Pipe
Depth Area” as determined by the WDNR. Once verification is determined, it may
be necessary to require the water main to be extended to the lot line of proposed lo t
#3 and connection of lot #3 to City water as well.
Recommendation:
Require connection of Lot #1 to public sanitary sewer and water. Further, only
require extension of water main and connection of lot #3 to public water should it be
determined that lot #3 is within a Special Well Casing Pipe Depth Area. Any public
improvements will require a Development Agreement and all standard City
requirements.

Subject: Request to purchase a portion of City owned property addressed as W180
S7677 Pioneer Drive (current lift station property).
Date: August 24, 2012
The attached request was received by the owner of the property directly adjacent to
the City’s Lift Station property addressed as W180 S7677 Pioneer Drive. The
property owner is requesting that the City sell a 45’ x 30’ portion of the City’s lift
station property to allow for additional parking for his building.
This property was purchased and is currently utilized as the site for a sanitary
pumping station. As part of the Pioneer Drive reconstruction, the top portion of this
land is being regraded to make the property more attractive to help improve the
aesthetics along Pioneer Drive. Also, as Pioneer Drive redevelops in the future,
there may be a potential to market the entire front portion of the property for
redevelopment as long as access to the pumping station is provided.
Recommendation:
Do not sell the property at this time. As the area redevelops, look at selling a large
portion on the open market for development.

Subject: Request to modify the existing “Bypass Lane Repayment Agreement” for
Belle Chasse Subdivision.
Date: August 24, 2012
The Developer of Belle Chasse Subdivision is requesting modification to the
previously approved repayment agreement for the installation of a bypass lane
along Durham Drive (attached).
This agreement required the repayment of monies the City expended to install the
bypass lane on Durham Drive at the entrance to the Belle Chasse Subdivision.
Currently, should the developer create even one additional lot, the entire repayment
amount would become due. The Developer is askin g if the agreement can be
modified so that the repayment can be prorated upon development.
Recommendation:
Discuss the request with the Developer and determine what the Committee would
like to approve.

Could you please forward this to Dave Simpson. Dave, per our discussion please
schedule the topic of the Belle Chasse obligation to pay for the Durham Drive bypass
lane before the Monday Public Works committe. I would like to discuss an option to
pay the obligation on a prorata share based on number of lots platted in our second
phase rather than the entire amount as we will likely plat fewer lots than the 43 lots that
we had originally anticipated when we obtained our approvals back in 2007. I will bring
materials to the meeting - thanks.

Subject: Janesville Road Reconstruction-Conveyance Easement for Utility Burial
Date: August 24, 2012
WE Energies, Time Warner Cable & AT&T had previoulsy requested that the
City of Muskego convey easements upon two City owned parcels, the Library
property and the retention pond property (Martin & Janesville).
The attached documents show the requested easements and the areas requested.
The City granted those easements in 2011, however, it was determined that the
easement on the retention pond property was not large enough to fit all of the
utilities.
The attached easement documents show the requested easement and the easement
previously approved. The previously approved easement was never recorded so
we can negate it with the approval of this easement.
As this utility burial was requested by the City and it doesn’t impact City property
negatively, I suggest accepting the Utility’s request for a no cost transfer per the
attached documents.
Recommendation for Action:
Approve conveyance of the new easement upon the City owned parcel for the burial
of overhead facilities for the Janesville Road Reconstruction project.
