CITY OF MUSKEGO unapproved PUBLIC WORKS COMMITTEE MINUTES OF MEETING HELD MONDAY, SEPTEMBER 17, 2012 Ald. Neil Borgman called the meeting to order at 6:00 PM. Also present were Ald. Robert Wolfe, Ald. Eileen Madden, Public Works Director David Simpson and Public Utilities Superintendent Scott Kloskowski. Ald. Borgman led those present in the Pledge of Allegiance. The meeting was noticed in accordance with the Open Meeting Laws on September 13, 2012. APPROVAL OF MINUTES OF AUGUST 27, 2012 Ald. Madden moved to approve the minutes of August 27, 2012. Seconded by Ald. Wolfe. Motion carried 3-0. STAFF REPORTS None STATUS OF PROJECTS Director Simpson gave updates on the following projects: Janesville Road Reconstruction – On schedule. Curbs may begin as early as next week or possibly even the end of this week. Median monument is also underway. Project has gone smoothly. Pioneer Drive Reconstruction – Should be putting binder pavement in tomorrow. Sidewalk is 95% complete. Curbs are all in. All utilities are buried, poles taken out. Going well. Hoping to be done by the end of October. Tess Corners Reconstruction – Utilities slowed us down. Crews will start Wednesday. Woods Road Recreational Trail – Trail is essentially done. Finish up restoration. UNFINISHED BUSINESS None NEW BUSINESS Update of Proposed Water and Sanitary Sewer Utility Budget – Superintendent Kloskowski stated these budgets aren’t complete because we are waiting for numbers from other people. Director Simpson advised that Finance Director Mueller will bring to last COW in September or first one in October. Capital charges for MMSD we know will be going up, we will meet with them on Friday. Sewer Utility looks strong – should be fine as far as a rate change. Water Utility we are going to wait through the end of this year to see how third and fourth quarters go to decide if 2013 will need a simplified rate case per Superintendent Kloskowski. Both of these budgets terminology is completely different than City Budget. Director Simpson stated we just wanted to update you, no recommendation at this point. 2 Review Proposed Intergovernmental Cooperation Plan between the City of Muskego and Waukesha County for the Design of the Racine Avenue Recreation Trail - Director Simpson advised during the Capital Budget planning process the Racine Avenue trail from Woods to Culvers was added into the capital budget process for next year. In order to do that we need to hire a consulting firm now to get the survey completed to move forward with the design on the project. I had been speaking with the County about this proposed project as they will be permitting and reviewing the project plans. The County asked if we would be interested in having them provide the survey and design of the project for a fee as they have the staff on hand to complete the work. We have a draft two party agreement from the County that will require a cost of $10,164.00 for Survey and Design of the project. If the Committee would like to move forward with the County helping complete the survey and design, we would have the City Attorney review the two party agreement and bring the final draft to Common Council for final approval. Ald. Madden made a motion for approval to move forward. Seconded by Ald. Wolfe. Motion carried 3-0. . Jeanne Struck Recording Secretary Page 1 of 2 CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Review resident request to cost share for the installation of a 36 inch diameter storm sewer within a drainage easement at S70 W13152 Woods Road Date: October 12, 2012 Mr. Larry Schroeder of S70 W13152 Woods Road has requested that the City of Muskego install a storm sewer within an existing drainage easement in his backyard in order to reduce the amount of maintenance that the homeowner would like to do. The easement has existed for years and is, in my opinion, very maintainable(see pictures) in its current state. The homeowner also has the option to allow the grass on the side slopes of the ditch grow in a natural state so that no lawn mowing would be required. With all that said, I did ask a contractor to provide a quote for the work that the homeowner is requesting so that the Committee can discuss and let the homeowner know if we would be willing to participate in any way in this process. I have attached the quote that shows a cost of $10,900-$13,500, depending upon when the work would be completed. The homeowner has offered to pay $4,000 of that cost. Also, restoration is not included in the contractor’s bid so that would need to be taken care of by the homeowner. Page 2 of 2 I do not feel it is appropriate for the City to contribute dollars to storm sewer improvements designed only to ease maintenance and make a property more aesthetically pleasing. Recommendation: Do not participate in any of the cost for this project. Should the homeowner wish to move forward, the City can provide assistance with the project management should the homeowner wish. CITY OF MUSKEGO Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Janesville Road Reconstruction- Recommendation of approval of Conveyance of Rights in Land related to existing City owned easements on Janesville Road Date: October 12, 2012 Waukesha County has requested that the City of Muskego convey existing City rights in land that exist on certain parcels on Janesville Road, between Racine Avenue and Lannon Drive. Along the Janesville Road corridor, there are City owned easements upon multiple parcels for various reasons including water main, sanitary sewer, storm sewer, and slope easements. As the County purchases land along the corridor, the easement rights that we own on these lands need to be released so that the new County right-of-way does not have easement encumbrances. The attached documents show the areas of requested easement release and documents for these conveyance of rights in land for all areas shown. As this is a mutually beneficial project, the County is requesting a no cost conveyance per the attached documents. Recommendation for Action by Council: Approve conveyance of rights in land for the Janesville Road Reconstruction project per the attached documents. Five (5) bids were received for the work from D.F. Tomasini, Inc. of Sussex, Wisconsin, Reesman’s Excavating & Grading, Inc. of Burlington, Wisconsin, Mid City Plumbing & Heating, Inc. of Butler, Wisconsin, Super Excavators, Inc. of Menomonee Falls, Wisconsin and Rawson Contractors, Inc. of Sussex, Wisconsin. All bidders acknowledged receipt of Addenda 1-3 for the project on the Bid Form and included Bid Bonds in the amount of 5% of their respective amounts bid. Therefore, the the bid amounts received were as follows: a. D.F. Tomasini, Inc. - $71,125.00 b. Reesman’s Excavating & Grading, Inc. - $73,545.00 c. Mid City Plumbing & Heating, Inc. - $74,750.00 d. Super Excavators, Inc. - $98,100.00 e. Rawson Contractors, Inc. - $111,500.00 All bidders exceeded our estimate of $50,000. This is believed to be primarily due to the remote locations of the work and the associated mobilization cost associated therewith. We included the first bid item (Mobilization / Demobilization and Construction Administration) to separate out these costs, somewhat significant depending upon each bidder, in order to provide bidders the opportunity to apply the actual costs of the work to each bid item. This reasoning allows changes in the actual constructed quantities to be compensated for appropriately. Also, given the fact that the lowest 3 bidders were within $3,700 (5%) of each other is demonstrative of the fact that these bidders centralized their bids around the reasonable price for this work. D.F. Tomasini’s alternate bid items pricing were reasonable and comparable to our estimates. Given the limited scope of this project, it is unlikely that these quantities would be utilized. AECOM and the City of Muskego have worked with D.F. Tomasini, Inc. previously and currently, D.F. Tomasini, Inc. completes all emergency water main breaks for the City of Muskego. D.F. Tomasini, Inc. did not supply a listing of subcontractors for this project, but given the limited scope of the project, the value of the work potentially completed by subcontractors would be limited. Therefore, AECOM recommends that the City of Muskego accept D.F. Tomasini, Inc.’s bid of $71,125.00 and award a Contract to the same for the lateral replacement or groundwater migration barrier installations for the 8 properties included in the project as they are the qualified low bidder. There are currently three private roads that City crews have historically plowed. It appears that a decision was made some time ago to plow these roads a nd the Public Works Committee has not reviewed this item in decades. The three areas are as follows: 1. End of Mystic Drive- 4 Homes 2. Boszhardt Lane- 3 Homes 3. End of Prigel Drive- 2 Homes There are many private drives within the City that do not receive City plowing services. By plowing on private property, the City is risking potential liability issues as our municipal indemnity may not extend onto private property. It is also no t equitable that we are providing this service to persons benefiting from the privacy of a private drive while also receiving the benefit of City snow removal. Recommendation: No longer plow any private drives within the City and inform all affected property owners. Page 1 of 2 CITY OF MUSKEGO Staff Report to Public Works Committee To: Public Works Committee From: David Simpson, P.E., Director of Public Works/City Engineer Subject: Discuss policy regarding mailbox repair/replacement when damaged by a City vehicle Date: October 12, 2012 Approximately 30 times per year, plowing activities damage a resident’s mailbox. The vast majority of the time the damage is attributed to airborne snow or ice leaving the end of a plow blade. Obviously this number varies depending on how much snow and how many plow operations we have in any given year. Damage ranges from bending the post or knocking off the mailbox to complete destruction of the mailbox and post. This requires repairs ranging from adjustment of the post or reinstallation of the mailbox to complete replacement of the mailbox and post. The City’s current policy and practice is to repair the mailbox if possible or to replace any mailbox and post with a standard mailbox on a 4-inch by 4-inch post constructed by City forces. Total costs for a new mailbox and post is about $20 for materials plus labor to install the mailbox or make a repair. We have received a few requests over the years that the City make mailbox repairs with in-kind materials or pay for mailbox repairs regardless of the cost of the box. There are some mailboxes in some areas that may cost well over $500 to replace. This brings up several questions regarding these boxes and what to do if they are hit. Some of the mailboxes can get quite ornate and elaborate. A survey was conducted by Brookfield of municipalities in Wisconsin on their policies regarding mailbox repair/replacement. The answers are not uniform. Policies in other communities range widely from not replacing the mailbox at all to replacing the mailbox at any cost. The answers are fairly evenly distributed among the responses and service levels for mailbox repair and replacement. I have attached a copy of the survey for your review. Given the above results and after consideration of some of the issues we have dealt with in the past, staff recommends amending our current practice to allow reimbursement to residents for mailbox repairs they complete themselves up to Page 2 of 2 $50.00. We recommend maintaining our practice of replacing mailboxes with a standard box and post, but allowing residents to make the repair themselves with a reimbursement as mentioned above. Recommendation: Maintain current practice of repairing or replacing mailboxes with a standard box and post. Also give the resident the option of receiving $50.00 from the City to complete the purchase and installation themselves as an alternative. In no case will the City pay more than $50.00 or replace a box with anything other than our standard.
