MINUTES OF MEETING HELD MONDAY, JUNE 20, 2011
Alderman Noah Fiedler called the meeting to order at 6:00 PM. Also present were
Aldermen Dan Soltysiak and Keith Werner, City Engineer David Simpson, Public Works
Superintendent Wayne Delikat and Public Utilities Superintendent Scott Kloskowski.
Ald. Fiedler led those present in the Pledge of Allegiance.
The meeting was noticed in accordance with the Open Meeting Law on June 17, 2011.
APPROVAL OF MINUTES OF MAY 16, 2011
Ald. Werner moved to approve the minutes of May 16, 2011. Seconded by Ald. Soltysiak.
Motion carried 3-0.
STAFF REPORTS
None
STATUS OF PROJECTS
Janesville Road Reconstruction (Moorland to Racine) – City Engineer Simpson stated
moving forward. Talked to County consultants recently and they hope to have 90% plans by
August 1, 2011.
Durham Drive Reconstruction & Sanitary Sewer Project – City Engineer Simpson advised
going well – should be to Schultz Ln. today.
McShane Pump Station Upgrade – Bypass pump is in per Public Utilities Superintendent
Kloskowski.
Storm Water Studies (Luehring Drive, Circle Drive, and Catalina Drive) – City Engineer
Simpson gave a status update. Luehring Drive is out for bid this Thursday. Circle Drive –
still waiting on district. Catalina Drive will talk about later.
PPII Reduction & Sanitary Sewer Backup Prevention Programs – City Engineer Simpson
stated everything approved. Letters should go out this week.

Approval of Application for a Simplified Rate Increase for the Water Utility – Director of
Finance & Administration Sharon Mueller stated during the 2011 budget process we
discussed the projected 2011 reduction within Water Utility Operations and Maintenance
Fund and the need to move forward with a simplified rate case. The 2010 Annual PSC
Water Utility report and the preliminary financial statements are completed. The PSC
notified the City it did qualify for a simplified rate increase of 3% based on 2010 audit
results. The downside of not proceeding forward with this application is the utility will most
likely continue on a downward trend which would lead to borrowing for any future capital
projects and the potential for utility to drop into a negative fund balance and this could have

a negative impact on the bond rating of the utility, and would not sit well with the Public
Service Commission. Ald. Werner made a motion for the rate increase by 3%. Ald.
Soltysiak seconded. Motion carried 3-0.
Request for a street to be named Skylark Court for a currently unnamed street off of Skylark
Lane south of Woods Road – City Engineer Simpson stated the City has a road which was
never named and the two affected residents are requesting that the City name the road
Skylark Court. Ald. Werner made a motion to name the currently unnamed street.
Seconded by Ald. Fiedler for purpose of discussion. Ald. Soltysiak stated he was okay with
naming the road, but the residents should pay for the sign. Ald. Werner advised we are
going through a sign change and we would be changing it regardless. Ald. Fiedler also
stated even if the developer would have put up a sign, we would be changing it. All in favor
of the amendment – fails. Original motion - carried 3-0.
Approval of a permanent sanitary sewer easement at S86 W18990-92 Woods Road – City
Engineer Simpson advised owners at S86 W18990-92 applied for an addition around 1999.
The City indicated they would need to vacate and recreate a sanitary sewer easement to do
so. The owners complied and the City told them it was completed and the City issued a
building permit. In a recent survey of their property it was discovered the easement was
never vacated and a new easement was not created. It would go to Council for final
approval. Ald. Soltysiak made a motion to for approval of a sanitary sewer easement at S86
W18990-92 Woods Rd. Ald. Werner seconded. Motion carried 3-0.
Approval of release of a platted sanitary sewer easement at S86 W18990-92 Woods Road –
City Engineer Simpson recommended approval of release of a platted sanitary sewer
easement at S86 W18990-92 Woods Rd. as discussed above. Ald. Soltysiak made a
motion for approval. Seconded by Ald. Werner. Motion carried 3-0.
Recommend approval of the Compliance Maintenance Annual Report (CMAR) for 2010 –
Public Utilities Superintendent Kloskowski stated this is a report required by the DNR;
basically it gives them a look at the health of the sewer utility and how it is being maintained.
Everything is good except for our four overflows related from our last year storm events
which gives us an “F grade” on the maintenance portion of it. We have a resolution of what
we are going to do with the overflows and would like to recommend the resolution to Council
for passage. Ald. Werner made a motion to approve. Ald. Soltysiak seconded. Motion
carried 3-0.
Discuss Engineer’s Estimate for the Catalina Storm Sewer Project – City Engineer Simpson
provided an old cost matrix which was discussed at a prior meeting regarding options and
cost estimates and felt the cost benefit was there to provide against the July 22, 2010 event.
The cost they were using was $157,500. This did not include restoration, structures, etc. so
we estimated $200,000 - $250,000 project. We had hired GRAEF and they have been
working on the design. The current cost they provided me is $620,000. GRAEF project
manager is no longer with them. Ald. Fiedler suggested having Staff go back and think
about options. Put on hold.

Subject: Cornell Storm Sewer Design
Date: July 15, 2011
As discussed at the previous Committee meeting, the engineer’s estimate for the
original proposed storm sewer route was much more than originally budgeted. The
original route was planned to go through Kurth Park and would have allowed the
option of adding a retention pond in the future. As design was nearing completion,
we found that the original cost estimate of $250,000 was going to be exceeded by
more than $250,000. Around this same time, State law requiring Cities to reduce
their TSS by 40% was rescinded. This gave us the opportunity to look into other
options.
GRAEF was able, at their own cost, to resize and relocate the proposed route
straight down Cornell Drive (see attached exhibit). We also eliminated the extra
pipe between the homes north or Cornell (as it is not necessary to reduce flooding)
and reduced the size of the relief pipe by calibrating the flood model to the July 22,
2011 rain event. We also intend on keeping the existing pipe and making any spot
repairs as needed. The attached cost estimates reflect two options. The first is a 21”
pipe that will protect against the July 22, 2011 rain event for an estimated cost of
$193,000. The second is a 24” pipe that will provide added protection for a cost of
$214,000. Also attached is a schedule that GRAEF has put together showing that we
can still build this project this year. There will be additional cost for the redesign in
the amount of $11,900 (see attached).
Recommendation for Action:
Recommend moving forward with survey, design, and bidding of a 24” storm sewer
down Cornell Drive per the attached proposal.

Bids for the Luehring Drive North and Hillview Drive Drainage Improvements &
Road Reconstruction were opened and read aloud on July 7, 2011 at 11:00 a.m. at
the City of Muskego City Hall and were as follows:

Musson Brothers, Inc. $211,307.00
The Wanasek Corporation $212,744.00
Willkomm Excavating $223,294.48
Reesman’s Excavating $251,692.00
D. F. Tomasini, Inc. $268,689.00
State Contractors $314,108.25
The low bid falls within the scope of the budgeted amount, which is $250,000.00.
The budget also includes funds utilized for inspection and design work.
I have reviewed the bid documents submitted by the apparent low bidder and
found that there are no errors or omissions with the submitted bid. Musson
Brothers, Inc. has submitted pre-qualification documents with the City of
Muskego and they meet our requirements.
Given that Musson Brothers, Inc. is the low bidder and has submitted an
acceptable prequalification statement, I recommend that their bid be accepted for
the Luehring Drive North and Hillview Drive Drainage Improvements & Road
Reconstruction project.
Recommendation for Action by Council:
Award the Luehring Drive North and Hillview Drive Drainage Improvements &
Road Reconstruction project to Musson Brothers, Incorporated.

Subject: 2011 Road Improvement Program- Award of Bid

Bids for the 2011 Road Improvement Program were opened and read aloud on
July 14, 2011 at 10:00 a.m. at the City of Muskego City Hall and were as follows:

1. Payne & Dolan, Inc. $477,890.95
2. Stark Asphalt $544,262.95
3. Black Diamond Group, Inc. $624,174.95
The low bid falls within the scope of the Road Program Budget for 2011, which is
$625,000.00. The road program budget also includes funds utilized for inspection
and design work. It may be possible to add additional roadwork into this year’s
project scope given the excellent unit bid items that were received.
I have reviewed the bid documents submitted by the apparent low bidder and
found that there are no errors or omissions with the submitted bid. Payne &
Dolan has submitted pre-qualification documents with the City of Muskego and
they also meet our requirements.
Given that Payne & Dolan is the low bidder and has performed well in past road
projects with the City, I recommend that their bid be accepted for the 201 1 Road
Improvement Program.
Recommendation for Action by Council:
Award the 2011 Road Improvement program to Payne & Dolan, Incorporated.

Subject: Tess Corners Creek Regional Detention Facility
Date: July 15, 2011
The City of Muskego received a letter from the City of New Berlin (dated June
14th, 2011, attached) requesting that the City of Muskego respond in writing as to
its position regarding the Tess Corners Creek Regional Detention Facility.
Tess Corners Creek Pond design and intermunicipal collaboration began in 2000.
After the loss of a grant, increased construction cost estimates, and time
extensions, the City of New Berlin officially pulled out of the project on December
14th, 2004 (see attached letter). I have also attached some news articles that discuss
the project’s past.
The pond’s preliminary design would have reduced the 100 year storm event flows
by approximately 37%, which would provide significant reductions to
downstream flooding in the City of Muskego. The pond would be located north of
College Avenue and west of Sunny Slope (see attached preliminary design). New
Berlin is now saying that the reduction in total suspended solids is not cost
effective for them and that they do not feel that moving forward with the project is
cost effective for that reason. That essentially leaves the City of Muskego with the
decision of how to proceed. The City of Muskego does not have this project
currently planned for in the five year capital improvement plan.
We could look for grant opportunities, however, it would be unlikely that a grant
would pay for a large percentage of the costs. Should the City of Muskego have to
take the project on without the City of New Berlin’s cooperation, we would have to
purchase the property without condemnation rights, meaning that we would have
to have a voluntary sale from all property owners involved.
Because of the location of the flooding in Muskego, the only opportunity to
mitigate the flooding downstream is the construction of this pond in New Berli n.
It would be a very costly investment, but one that the City may wish to make at
some point.
Recommendation for Action by Committee:
Direct staff to write a letter to New Berlin regarding the Committee’s position on
the future construction of the Tess Corners Creek Pond.
