CCR2016___-Unsubstantial Change-MuskegoBeachPD COMMON COUNCIL - CITY OF MUSKEGO RESOLUTION #___-2016 APPROVAL OF UNSUBSTANTIAL CHANGE TO PLANNED DEVELOPMENT (PD) MUSKEGO BEACH CLUB DEVELOPMENT WHEREAS, A Planned Development zoning amendment was approved for the Muskego Beach Development, as part of the PD-14 Bay Breeze Zoning District, by the Common Council per Ordinance #1400 on September 8, 2015 ; and WHEREAS, The Planned Development allowed “…a total of eleven (11) units to exist over a total of approximately 6.7 acres which consisted of an existing single-family home to remain, and ten single family “beach homes” ….”, and. WHEREAS, The developers are finalizing their condo plat and certified survey map approvals with the Planning Commission and have submitted the new site plans for these final approvals, and WHEREAS, The new site plan shows the development to substantially conform to the rezoning approvals although the developers have now reduced the ten (10) single family beach homes to eight (8) single-family beach homes, and WHEREAS, The Muskego zoning code states that the Council shall find that any change to an approved plan is unsubstantial, upon recommendation from the Planning Commission, or that a new public hearing would have to take place. NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of Muskego, upon the recommendation of the Plan Commission, does hereby approve of an unsubstantial change to the Muskego Beach Planned Development. BE IT FURTHER RESOLVED, That the change is unsubstantial due to the reduction of the amount of units on the proposal since the adoption of Ordinance #1400. BE FURTHER RESOLVED, That the condominium declaration restriction and/or deed restriction required as part of Ordinance #1400, regulating the total amount of units allowed for the Muskego Beach Development, shall now reflect the eight (8) units on the condo parcel and the one (1) single family home on the single family parcel.
