PARK ARTHUR EQUESTRIAN TRAIL AGREEMENT
This agreement is made and effective as of the ______ day of _________, 2013, and runs
thru the _______ day of __________, 2015, by and between Bob Janke d/b/a 4 J’s
Equestrian Center (“stable owner”) and the City of Muskego (the “City”). This
agreement is renewable with consent of both parties.
Section One: Introduction
Purpose and Location:
A. An equestrian use only trail will be planned for Park Arthur in exchange for
the stable owners to help develop and maintain the trail.
B. Trail location shall be more or less as set forth on the attached map.
Section Two: Contact Persons
Contact person from the 4 J’s Equestrian Center will be owner Bob Janke.
The contact for the City of Muskego will be the Parks & Recreation Director.
Section Three: Maintenance and Operation Responsibilities of Equestrian Trail by
Stable Owner
A. Responsible for assisting in the layout of the equestrian trail.
B. Once trail is developed, responsible for keeping path graded, timely removal
of horse droppings and litter from trail, and spreading of wood chips by ways
of stable owned manure spreaders and other owned equipment.
C. Responsible for educating stable owner’s customers on proper use of the
equestrian trail.
D. Responsible for helping to identify areas along the trail to stockpile wood
chips for easy access and assisting in providing woodchips for said stockpiles.
E. Responsible for weekly inspections of trail and to notify city contact if
problems arise.
F. Responsible for assisting the city in developing rules and associated signage
for trail users.
G. With approval by stable owner, the 4-J’s Equestrian Center’s private
equestrian trail will be allowed to be used by Park Arthur horse riders.
Section Four: Maintenance and Operation Responsibilities of Equestrian Trail by
the City of Muskego (Parks & Recreation)
A. Responsible for developing the equestrian trail that includes proper grading
plan and storm water plan.
B. Assist in identifying areas along the trail to stockpile wood chips for easy
access and in providing woodchips for said stockpiles.
C. Responsible for purchasing and installing signage along the trail and in
parking lot for trailer stalls (if needed).
D. Monitor trail once per month to insure safety and cleanliness. Findings will
be communicated to stable owner contact.
Section Five: Lease Provisions
ASSIGNMENT: This lease shall not be assigned by the stable owner without the
expressed written consent of the Parks & Recreation Board.
TERM: This contract is for a two (2) year term commencing on the _____ day of
________, 2013, and ending on the _____ day of _____________, 2015.
TERMINATION: If either party fails, at the sole discretion of the other party, to honor
their responsibilities, as written, this Agreement will be terminated and the Park Arthur
Equestrian Trail will be closed.
TRAIL LOCATION: The City shall have the sole final determination as to the location
and use of the trail.
END OF YEAR REVIEW: Both parties shall come together at the November Parks and
Recreation Board meeting to review the status (problems, users, terms of agreement, etc.)
of the equestrian trail.
IN WITNESS WHEREOF, the parties have executed this agreement.
