ORD20201444-CDA COMMON COUNCIL - CITY OF MUSKEGO ORDINANCE #1444 AN ORDINANCE TO AMEND CHAPTER 12, TO REPEAL SECTION 12-8, OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO (Community Development Authority) WHEREAS, The Common Council of the City of Muskego created the Community Development Authority (CDA) with the adoption of Resolution #063-2002 on March 26, 2002; and WHEREAS, The creation of the CDA was for the purpose of blight elimination and prevention, slum clearance and prevention, urban renewal and development, and community development and redevelopment projects in support of healthful homes, decent living environment, adequate places of employment and to increase the general property tax base; and WHEREAS, Significant development has occurred since 2002 resulting in improved economic conditions and residential growth in the City changing and improving the market base; and WHEREAS, Established Tax Incremental Districts have closed or are near closing having served their purpose of new development and redevelopment; and WHEREAS, Due to such development as stated herein, the CDA has not had the need to meet in recent years; that it is not desirable or practical to have a Commission or Committee in place that does not actively meet; and WHEREAS, As a result of the same, at the March 30, 2020 Common Council meeting, it was recommended by Mayor Chiaverotti that the CDA be dissolved; that there were no objections from any members of the Council. THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN DO ORDAIN AS FOLLOWS: SECTION 1: Chapter 12, Section 12-8., of the Municipal Code of the City of Muskego, is hereby repealed. SECTION 2: The several sections of this Ordinance are declared to be severable. If any section or portion thereof shall be declared by a decision of a court of competent jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to the specific section or portion thereof directly specified in the decision, and not affect the validity of all other provisions, sections, or portion thereof of the Ordinance which shall remain in full force and effect. Any other Ordinance whose terms are in conflict with the provisions of this Ordinance is hereby repealed as to those terms that conflict. SECTION 3: This Ordinance shall be in full force and effect from and after its passage and publication. Ordinance #1444 TH PASSED AND APPROVED THIS 26 DAY OF MAY 2020.
