AN ORDINANCE TO ADD CHAPTER 1, SECTION 1.12
OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO
(Department of LawEngineering)
THE COMMON COUNCIL OF THE CITY OF MUSKEGO, WISCONSIN, DO ORDAIN
AS FOLLOWS:
SECTION 1: Chapter 1, Section 1.12 is hereby added to read as follows:

1.12 DEPARTMENT OF LAWENGINEERING.

The Department of LawEngineering is hereby established and shall include the City
AttorneyEngineer and such employees as the Council may provide from time to time.
(1) APPOINTMENT.
The The City Engineer shall be appointed by the Mayor, subject to confirmation by the
Council, and shall serve at the pleasure of the Mayor and Council.until his successor is
appointed and qualifies.
tCcity AttorneyEengineer shall be nominated by a hiring committee appointed appointed
by the Mmayor which also shall advise on the terms and conditions of a written contract
between the City and the nominee. The Mayor may serve on the hiring committee as its
chair or as a regular committee member. Any such nomination shall be subject to
confirmation by a majority vote of the Common Council.
(2) TERM, COMPENSATION AND BENEFITS.
c an wThe term of the attorney shall not have a fixed end date. The terms,
compensation and benefits of the attorney shall be as provided in a written contract.
The contract may be terminated at any time with or without cause, upon the
recommendation of the Mayor and by a majority vote of the entire Common Council. If
the contract is terminated without cause, there may be severance provisions
established in the contract.

The City Attorney shall have the duties and responsibilities of the city attorney as is
provided in Wis. Stats. §62.09(12), along with such other similar services as are from
time to time requested or delegated by the Mayor or Common Council.

(4) SUBORDINATE TO THE MAYOR.
The City Attorney and any assistant attorneys shall be directly subordinate to the Mayor
and subject to the policy direction of the Common Council.
(3) SECTION 2: The several sections of this ordinance are declared to be severable. If
any section or portion thereof shall be declared by a decision of a court of competent
jurisdiction to be invalid, unlawful, or unenforceable, such decision shall apply only to
the specific section or portion thereof directly specified in the decision, and not affect the
validity of all other provisions, sections, or portion thereof of the ordinance which shall
remain in full force and effect. Any other ordinanceordinances whose terms are in
conflict with the provisions of this ordinance are hereby repealed as to those terms that
conflict.

publication.
