APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR BURBACK BUILDERS
LLC IN THE NW ¼ OF SECTION 16 (TAX KEY NO. 2221.016.001 / W185 S8095
RACINE AVENUE)
WHEREAS, On November 19, 2004 plans were submitted by Burback Builders LLC for an
amendment to a Building, Site and Operation Plan for a property located in the Muskego
Industrial Park located in the NW ¼ of Section 16 (Tax Key No. 2221.016.001 / W185
S8095 Racine Avenue), and
WHEREAS, Said property is zoned I-1 Industrial Park District, and said use is a permitted
use by right subject to Building Site and Operation Plan approvals, and
WHEREAS, The site currently consists of two structures, one of which is 3,072 square feet
used for office space and a 3,200 square-foot outbuilding for warehousing, and
WHEREAS, The site currently has overgrown landscaping and overgrowth within the
gravel access ways, and
WHEREAS, The Petitioner proposes to alter the current site by adding a second floor with
three new gables to the office building, adding a front doorway and more windows to the
office building, while also updating landscaping, and parking arrangements on the site,
and said proposal meets the bulk requirements of the Zoning Code, and
WHEREAS, The Petitioner also is requesting preliminary approval of two new storage unit
buildings consisting of a 4,000 square-foot unit in the northwest portion of the property and
a 8,000 square-foot unit in the southwest portion of the property, and
WHEREAS, Building materials and colors used on the newly updated office structure will
include new weatherwood colored dimensional asphalt shingles, new almond colored
casement windows, new beige colored Miratec corners and wraps, new taupe colored
hardi-plank siding, and the existing stone belt line, and
WHEREAS, The building does not meet the 50% masonry requirement for a commercial
structure in the City’s General Design Guide, however the building is existing and will be
extensively updated, and
WHEREAS, Parking is illustrated as 5 parking stalls for public use and 5 stalls for
employee use and the public stalls appear to be under the 10’x20’ requirement, and
WHEREAS, 1 space of parking is needed for every 2 employees in an industrial use and
the parking depicted allows for this plus additional spaces for customers, and
WHEREAS, No additional lighting is shown on the new plans and any new lighting would
need Plan Commission approval, and
WHEREAS, No area is designated for refuse/recycling and Plan Commission approval
would be needed if an enclosure is sought, and
WHEREAS, A monument sign location is shown although no specific signage is proposed
at this time and Plan Commission and/or staff approval may be needed when signage is
requested, and
WHEREAS, A landscape plan is depicted within the submittal and some updates are
needed as per the City Forester, and
WHEREAS, An existing chain link fence exists around the majority of the property and a
new wood plank fence is to be located facing the Racine Avenue right-of-way on the
northern portion of the office building and a decorative iron gate with an auto operated
keypad is to be located on the south portion of the office building, and
WHEREAS, Access is provided to the site with one entrance off of Racine Avenue that is a
concrete surfaced drive and the current access is sufficient for the site, and
WHEREAS, Stormwater management may need to occur and would have to be located on
the property to be approved by the Engineering Department before work commences, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended
Building, Site and Operation Plan for the Burback Builders LLC located in the NW ¼ of
Section 16 (Tax Key No. 2221.016.001 / Racine Avenue).
BE IT FURTHER RESOLVED, The approval is for the current site alterations and
conceptual approval for the storage facilities.
BE IT FURTHER RESOLVED, Final Plan Commission approvals will be required for the
proposed storage facilities and the submittal must include a revised site plan, building
elevations, and any other details that relate to the addition of the storage facilities at that
time.
BE IT FURTHER RESOLVED, The need for stormwater management for the current site
will be determined by the Engineering Department at the time of building permits.
BE IT FURTHER RESOLVED, That if a outdoor refuse facility is sought it will need to have
locations and building elevations approved by the Planning Department and/or Plan
Commission.
BE IT FURTHER RESOLVED, That no mechanicals are shown to adorn the roof and if
any are required they must be screened from view and colored to match the principal
structure.
BE IT FURTHER RESOLVED, That the landscape plan shall be enhanced according to
the comments from the City Forester and submitted for approvals prior to the release of
building permits.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to drainage shall be maintained
in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal
action, or both.
