APPROVAL OF A TWO (2) LOT LAND DIVISION FOR THE HENRICHS
PROPERTY LOCATED IN THE SE ¼ OF SECTION 24
(TAX KEY NO. 2256.987.002 / W126 S9453 NORTH CAPE ROAD)
WHEREAS, On November 9, 2004 a Certified Survey Map was submitted by
Landcraft Survey and Engineering for a two (2) lot land division of the property
located in the SE ¼ of Section 24, (Tax Key No. 2256.987.002 / W126 S9453
North Cape Road), and
WHEREAS, Said property is zoned RS-3 Suburban Residence District requiring
minimum lot size of 15,000 square feet and an average minimum width of 100
feet and one of the parcels does not currently meet the average minimum width
of said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside
for medium density residential development and this proposal is within this goal,
and
WHEREAS, Said parcels will be serviced by municipal sewer and Lot 1 will be
serviced with municipal water and Lot 2 with a private well, and
WHEREAS, They will only be allowed one access point off of North Cape Road
for the two lots.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the
Certified Survey Map submitted by Landcraft Survey and Engineering for a two
(2) lot land division of the property located in the SE ¼ of Section 24, (Tax Key
No. 2256.987.002 / W126 S9453 North Cape Road), subject to resolution of
technical discrepancies as identified by the City Planning Department and City
Engineers, and payment of all applicable fees in Section 18.14(3) of the Land
Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That Lot 2 shall be reconfigured to have an
average width of 100 feet as determined by the City’s Zoning Code.
BE IT FURTHER RESOLVED, That a note shall be added to the existing shed on
Lot 1 stating that it will be removed within 1 year from recording of the CSM
unless a principal structure is associated with Lot 1.
BE IT FURTHER RESOLVED, That both lots will need to share an access point
off of North Cape Road and that the needed easements be shown on the CSM.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted
to the City in accordance with Common Council Ordinance No. 1118 and
Resolution 196-2002.
