APPROVAL OF A RUSTIC STRUCTURES CONDITIONAL USE GRANT FOR THE RUSDAHL
PROPERTY LOCATED IN THE NW ¼ OF SECTION 13
(W135 S8266 DURHAM DRIVE / TAX KEY NO. 2210.989)
WHEREAS, A Petition was received on October 13, 2004 for a Rustic Structures Conditional Use Grant
designation for an outbuilding located on the Rusdahl property at W135 S8266 Durham Drive, and
WHEREAS, The property is zoned RSE Suburban Estate District, and the Plan Commission has
determined that the proposed designation is permitted by Conditional Use Grant, and
WHEREAS, The property contains 1,922 square feet of accessory structures including a barn totaling
1,622 square feet and a wooden shed totaling 300 square feet, and the property is permitted 1,387
square feet of accessory structures by Code, and
WHEREAS, The wooden shed totaling 300 square feet is to be removed as part of a future land division
leaving the total of accessory structure square footage at 1,622 square feet, and
WHEREAS, The designation of the one barn as a Rustic Structure would exempt them from floor area
calculations and result in a lot with the appropriate amount of accessory structure square footage, and
WHEREAS, A Public Hearing was held on November 16, 2004 before Plan Commission, and
WHEREAS, The Building Department has inspected the structure and has found no safety
concerns or structural problems, and
WHEREAS, Conservation Commission reviews a rustic structure petition and has recommended
approval on December 14, 2004.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Conditional Use Grant for the
1,622 square foot barn located on the Rusdahl property at W135 S8266 Durham Drive and as shown on
the Certified Survey Map approved by Resolution #PC 103-2004.
BE IT FURTHER RESOLVED, That this Conditional Use Grant shall be subject to annual review by the
Planning Department Plan Commission and Conservation Commission during the month of March
and any operations which are deemed to be inconsistent with this approving resolution may be subject to
further conditions by the Plan Commission and Conservation Commission.
BE IT FURTHER RESOLVED, That at the call of the Planning Department, the operations subject to this
Conditional Use Grant may be subject to further review by the Plan Commission, and any future
operations which are deemed to be inconsistent with this approving resolution may be subject to further
conditions by the Plan Commission.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and
that all aspect of this plan as they relate to landscape areas building facades and drainage shall be
maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall
result in the imposition of fines of $100 per day, the initiation of legal action, or both.
