APPROVAL OF A FOUR (4) LOT LAND DIVISION FOR THE PELLMAN PROPERTY
LOCATED IN THE SE ¼ OF SECTION 10
(TAX KEY NO. 2200.998 / WOODS ROAD)
WHEREAS, On September 1 2004 a Certified Survey Map was submitted by Ruth
Pellman for a four (4) lot land division of the property located in the SE ¼ of Section 10,
(Tax Key No. 2200.998 / Woods Road), and
WHEREAS, Said property is zoned RS-2 Suburban Residence District requiring
minimum lot size of 20,000 square feet and an average minimum width of 110 feet and
parcels meet said minimum zoning requirements with the exception of Parcel 1, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for
residential development and this proposal is within this goal, and
WHEREAS, The configurations of the lots meet the provisions set forth in the City’s Land
Division Code, although one of the lot configurations is slightly nonconforming, and
WHEREAS, Said parcels will be serviced by municipal sewer and water facilities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified
Survey Map submitted by Ruth Pellman for a four (4) lot land division of the property
located in the SE ¼ of Section 10, (Tax Key Nos. 2200.998 and / Woods Road), subject
to resolution of technical discrepancies as identified by the City Planning Department
and City Engineers, and payment of all applicable fees in Section 18.14(3) of the Land
Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That Parcel 1 be reconfigured to have an average width
of 110 feet as determined by the City’s Zoning Code.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the
City in accordance with Common Council Ordinance No. 1118 and Resolution 196-
2002.
BE IT FURTHER RESOLVED, That approval is subject to a developer’s agreement
regarding the construction of a recreation trail along Woods Road.
