RESOLUTION #P.C. 103-2004
APPROVAL OF A THREE (3) LOT CERTIFIED SURVEY MAP FOR THE RUSDAHL
PROPERTY LOCATED IN THE NW ¼ OF SECTION 13
(W135 S8266 DURHAM DR. / TAX KEY NO. 2210.989)
WHEREAS, On September 8, 2004 a Certified Survey Map was submitted by Eric
Rusdahl and Adam Rusdahl for a three (3) lot land division located in the NW ¼ of
Section 13, (W135 S8266 Durham Dr. / Tax Key No. 2210.989), and
WHEREAS, The proposed land division would create three lots with sizes of 40,000
square feet, 40,000 square feet, and 52,206 square feet and minimum widths of 150
feet, and
WHEREAS, Said property is zoned RSE – Suburban Estate District, requiring minimum
lot sizes of 40,000 square foot and average minimum widths of 150 feet, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for low
density residential development, and this proposal is consistent with this goal, and
WHEREAS, Lot #1 will have the option of private well or municipal water, Lot #2 will
have a private well, and Lot #3 will be serviced with municipal water, and all will be
served by municipal sewer, and
WHEREAS, Rights of way on Durham Dr. will need to be dedicated in accordance with
the 2010 Street System Plan, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified
Survey Map submitted by Eric Rusdahl and Adam Rusdahl for a three (3) lot land
division located in the NW ¼ of Section 13, (W135 S8266 Durham Dr. / Tax Key No.
2210.989), subject to resolution of technical discrepancies as identified by the City
Planning Department and City Engineers, and payment of all applicable fees in Section
18.14(3) of the Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That 50’ of the Durham Drive right-of-way needs to be
dedicated since said ultimate right-of-way width is 100 feet.
BE IT FURTHER RESOLVED, That the CSM needs to show the buildable area on each
parcel.
BE IT FURTHER RESOLVED, That the CSM needs to show the drainage ditch on the
property and a minimum of a 20-foot public drainage easement covering said drainage
ditch.
BE IT FURTHER RESOLVED, That the existing wooden shed located on the parcel line
between Lot #2 and Lot #3 will have to be razed within 6 months of the recording of the
CSM.
BE IT FURTHER RESOLVED, That the existing wooden barn, if larger than 1,387
square feet (to be determined from the technical corrections to the CSM), will need to be
removed within 6 months of the recording of the CSM, altered to 1387 square feet or
less, or pursued as a possible rustic structure.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the
City in accordance with Common Council Ordinance No. 1118 and Resolution #196-
2002.
BE IT FURTHER RESOLVED, That research will be done to determine if there is an
existing Conditional Use Grant on the property.
