APPROVAL OF A TWO (2) LOT LAND DIVISION FOR THE ERDMANN
PROPERTY LOCATED IN THE NE ¼ OF SECTION 25
(TAX KEY NOS. 2257.981 and 2257.982 / Loomis Drive)
WHEREAS, On September 1 2004 a Certified Survey Map was submitted by
Dale and Mark Erdmann for a two (2) lot land division of the property located in
the NE ¼ of Section 25, (Tax Key Nos. 2257.981 and 2257.982 / Loomis Drive),
and
WHEREAS, The proposed land division would create two lots, one of 30,001
square feet, and another of 43,371 square feet, and
WHEREAS, Said property is zoned B-4 Highway Business District requiring
minimum lot size of 30,000 square feet and an average minimum width of 150
feet and parcels meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside
for commercial development and this proposal is within this goal, and
WHEREAS, The configurations of the lots meet the provisions set forth in the
City’s Land Division Code, although one of the lot configurations is slightly
irregular, and
WHEREAS, Said parcels will be serviced by municipal sewer and private water
facilities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
Certified Survey Map submitted by Dale and Mark Erdmann for a two (2) lot land
division of the property located in the NE ¼ of Section 25, (Tax Key Nos.
2257.981 and 2257.982 / Loomis Drive), subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers,
and payment of all applicable fees in Section 18.14(3) of the Land Division
Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the right-of-way along North Cape Road
needs to be dedicated to an ultimate width of 100 feet.
BE IT FURTHER RESOLVED, That before Common Council approval is granted,
the City needs to have in hand the document that shows that the northern portion
of the CSM has been deeded to the Erdmann’s.
BE IT FURTHER RESOLVED, That any concerns about the right-of-way
dedication will need to be handled with a letter of no objection from Waukesha
County or the State of Wisconsin Department of Transportation.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted
to the City in accordance with Common Council Ordinance No. 1118 and
Resolution 196-2002.
