RESOLUTION #P.C. 093a-2004
APPROVAL OF SKETCH PRELIMINARY PLAT FOR A PROPERTY LOCATED
IN THE SE ¼ OF SECTION 4 (TAX KEY NO. 2173.991 / MARTIN DRIVE)
WHEREAS, On August 3, 2004 a sketch preliminary plat was submitted by Glen
Miller for the Martin property located in the SE ¼ of Section 4 (Tax Key No.
2173.991 / Martin Drive), and
WHEREAS, On September 1, 2004 an updated sketch preliminary plat was
submitted by Glen Miller for the Martin property located in the SE ¼ of
Section 4 (Tax Key No. 2173.991 / Martin Drive), and
WHEREAS, Within the new submittal there is one plan are two plans and
the plan labeled “smaller lots” will be known as Plan 1 and the plan labeled
“larger lots” will be known as Plan 2, and
WHEREAS, The plan consists of approximately 18.2 15.87 acres, proposes 24
single-family parcels and 2 outlots, and
WHEREAS, Access is shown in the appropriate location along Martin Drive,
although access is not shown to incorporate existing Rossmar Drive, and
WHEREAS, Said properties are zoned RS-2 Suburban Residence District and
parcels will the plat may require a rezoning with the OPD Planned Development
District to allow some lots to be around 18,000 square feet, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for low density
residential development and parcels will require an amendment to medium
density residential development, and
WHEREAS, Said parcels will be serviced by City sanitary sewer and the water
source will be determined by Public Utilities, and
WHEREAS, Martin Drive is depicted to have an ultimate width of 100-feet
consistent with the 2010 Street System Plan, and the concept does not show
this, and
WHEREAS, The cul-de-sac depicted is within the 1,320-foot max that the land
division code allows, although a cul-de-sac may not be needed, and
WHEREAS, The Plat is required to provide on-site stormwater management as
required by Chapter 34, and stormwater is depicted to be handled in detention
facilities within the outlots, and
WHEREAS, Park and Conservation Boards will determine needs of possible
trails and the acquisition of outlots at the time of concept plat preliminary plat,
and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
15.87 18.2 acre, sketch preliminary plat as proposed by Glen Miller for the Martin
property located in the SE ¼ of Section 4 and will be receptive to the submittal of
a preliminary plat and comprehensive plan amendment, and rezoning.
BE IT FURTHER RESOLVED, Park and Conservation Boards will determine
the needs of possible trails and the acquisition of outlots at the time of
concept plat as these determinations could affect the application for an
OPD zoning district.
BE IT FURTHER RESOLVED, That a conceptual rezoning, to the OPD
Planned Development District for decreased lot sizes, is not granted by
Plan Commission at this time, however a rezoning may be warranted if the
Park or Conservation Boards determine that dedication of the outlot will be
an asset to the City in the future. If however, it is determined that there is
no need for the City to acquire the outlots for future park or conservation
purposes, a rezoning to the OPD Planned Development District is not
deemed warranted by Plan Commission for the decrease in lot sizes and
the future Preliminary Plat should reflect the densities of the existing RS-2
zoning district.
BE IT FURTHER RESOLVED, Dedications along Martin Drive will need to be
addressed.
BE IT FURTHER RESOLVED, All environmental will need to be delineated
including high water marks of navigable streams, any wetlands, and forested
areas.
BE IT FURTHER RESOLVED, No access points should be shown on a
preliminary plat to Pearl and Earl Drives. Access should come off of Rossmar
Drive and Martin Drive only.
BE IT FURTHER RESOLVED, A plan for access to Martin Drive should be
worked out with the City’s Engineering Department before preliminary plat.
BE IT FURTHER RESOLVED, The parcel abutting Rossmar Drive will need to be
acquired by the developer and become a part of the preliminary plat so Rossmar
Drive may go thru for access or a formal letter from the property owner must
be included in the preliminary plat submittal of the owner’s intent of the
parcel.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and
final action is only an indication of the current intent of the Plan Commission;
Final submittals are subject to future review and consideration by the Plan
Commission, municipal committees of jurisdiction, and other agencies, and
approval of final plans is not guaranteed by this action of the Plan Commission.
