APPROVAL OF A FOUR (4) LOT LAND DIVISION FOR THE RAGUS
PROPERTY LOCATED IN THE NE ¼ OF SECTION 7
(TAX KEY NO. 2185.994 / Field Drive)
WHEREAS, On August 17, 2004 a Certified Survey Map was submitted by Dave
Ragus Jr. for a four (4) lot land division of the property located in the NE ¼ of
Section 7, (Tax Key No. 2185.994 / Field Drive), and
WHEREAS, The proposed land division would create three residential lots over 3
acres each and one outlot of 3,794 square feet, and
WHEREAS, Said property is zoned RCE Country Estate District requiring
minimum lot size of 120,000 square feet and an average minimum width of 250
feet and parcels meet said minimum zoning requirements, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside
for rural density residential development and this proposal is within this goal, and
WHEREAS, The configurations of the lots meet the provisions set forth in the
City’s Land Division Code, although the lot configurations are slightly irregular,
and
WHEREAS, There currently are two residential homes on the property and the
proposed land division will separate each home onto their own parcel and also
create one new residential parcel and one new outlot, and
WHEREAS, Said parcels will be serviced by private sewer and private water
facilities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a
Certified Survey Map submitted by Dave Ragus Jr. for a four lot land division
located in the NE ¼ of Section 7, (Tax Key No. 2185.994 / Field Drive), subject to
resolution of technical discrepancies as identified by the City Planning
Department and City Engineers, and payment of all applicable fees in Section
18.14(3) of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That Outlot 1 will be dedicated to the City of
Muskego for open space purposes so that adjoining parcels will not receive any
increased setbacks from the layout of the CSM.
BE IT FURTHER RESOLVED, That the area of Parcel 1 stemming north of the
south lot line of Parcel 2 shall be kept as open space and that no structures,
including fences and/or paving/asphalting, shall be put upon this area due to the
irregular access of this parcel and that the irregular division of Parcel 1 was done
to meet minimum area requirements only.
BE IT FURTHER RESOLVED, That a conservation management document shall
be recorded with the CSM to aide in the management of the lands that are
identified in the City’s Conservation Plan.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted
to the City in accordance with Common Council Ordinance No. 1118 and
Resolution 196-2002.
