APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT
FOR A MINI-WAREHOUSE FOR NANCY MIENERZ AT THE PROPERTY LOCATED IN THE SE ¼
AND SW ¼ OF SECTION 25 (LOOMIS DRIVE / TAX KEY NO. 2259.995.004)
WHEREAS, On May 26, 2004 plans were submitted by Nancy Meinerz for a Building, Site and Operation
Plan and Conditional Use Grant for a mini-warehouse, self-storage building located in the SE ¼ and SW ¼
of Section 25 (Tax Key No. 2259.995.004), and
WHEREAS, The petitioner is proposing four self-storage structures, each being approximately 3,800
square feet in area, and
WHEREAS, The 2010 Comprehensive Plan depicts the area for agriculture and low density residential use,
and a petition has been filed to amend the Plan to depict commercial uses consistent with the B-3 and B-4
District, and a public hearing has been conducted by the Common Council on July 13, 2004, and Plan
Commission action is to amend the 2010 Plan is addressed by Resolution #PC 071-2004, and
WHEREAS, Said property is currently zoned RSE Suburban Residence District and A Agriculture District,
and a petition has been filed to rezone the property to the B-4, Highway Business District, and a public
hearing has been scheduled before the Common Council on July 13, 2004, and Plan Commission action is
to amend the 2010 Plan is addressed by Resolution #PC 113-2003, and,
WHEREAS, Said use is a permitted use in the B-4 District by Conditional Use Grant, and a public hearing
has been conducted by the Plan Commission on July 6, 2004, and
WHEREAS, The adopted Conservation Plan does not outline the area for acquisition or management
initiatives, and
WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not propose acquisitions in the area,
and
WHEREAS, The proposal is consistent with the 2010 Street System Plan, and
WHEREAS, Said parcel will be serviced by municipal sanitary sewer and private well, and
WHEREAS, The property is subject to Chapter 34 of the Municipal Code, and a stormwater management
plan has been submitted to the Engineering Department, and may be subject to technical issues that must be
resolved, and
WHEREAS, Off street parking is provided and fencing will surround the development and additional
detail is needed for both, and
WHEREAS, Lighting is proposed for the development, and photometrics and lighting specifics have not
been provided, and
WHEREAS, No trash enclosure is proposed on-site, and
WHEREAS, No bollards are shown on the corners of the structures, and
WHEREAS, The landscape plan has been reviewed by the City Forester, and revisions are necessary, and
WHEREAS, No signage is proposed for the development, and all signage must be approved by the Plan
Commission prior to installation.
WHEREAS, The building is subject to the Durham Hill Design Guide as the property is adjacent to the
guides geographic area and said guide should include all adjacent commercial areas, and cupolas with
finials are illustrated to adorn the roof, and the office entry includes a “country trading post” element, and
the building represents the intent of the Design Guide, and
WHEREAS, Under the General Design Guide, all commercial buildings are required to be composed of at
least 50% masonry, and the buildings depicted do not meet this requirement with the Brick Veneer,
although Plan Commission may find that the buildings meet the intent of the Durham Hill Design Guide,
and
WHEREAS, The Durham Hill Design Guide which promotes designs that coexist with the rural
surroundings and historical origins of the area, and the buildings depicted appear to meet the requirements
of this guide offering materials of brick veneer, cedar siding, dimensional roof shingles, and various gable,
cupola, door, and window designs, and
WHEREAS, Mechanicals are not illustrated on the plan, but must be screened from view.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan and Conditional Use Grant for a mini-warehouse, self-storage building submitted May 26,
2004 by Nancy Meinerz for property located in the SE ¼ and SW ¼ of Section 25.
BE IT FURTHER RESOLVED, The stormwater management plan must be approved by the Public Works
Committee prior to the release of building permits.
BE IT FURTHER RESOLVED, All disturbed areas on the site are required to be sodded, and these areas
must be illustrated on the landscape plan.
BE IT FURTHER RESOLVED, A revised landscaping plan shall be approved by the City Forester prior to
the release of building permits.
BE IT FURTHER RESOLVED, Security lighting shall be illustrated on the site plan, and photometric
plans are required to be approved by the Plan Commission prior to the release of building permits.
BE IT FURTHER RESOLVED, That Building D shall include 50% brick veneer on the south elevation to
match the other structures on the property.
BE IT FURTHER RESOLVED, That the structures illustrated meet the intent of the Durham Hill Design
Guide with the architectural elements portrayed and do not require 50% masonry product.
BE IT FURTHER RESOLVED, That the specifics of the parking, bollards, and fencing must be shown on
the site plan along with elevation drawings and color specifics. This will have to be resubmitted to the
Plan Department, and once approved by Planning staff the updates will become a part of the approved Plan
Commission submittal.
BE IT FURTHER RESOLVED, That if a trash enclosure is needed the elevation models and location will
need to be approved by Plan Commission.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and
that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in perpetuity
unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping
and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be
submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall
result in the imposition of fines of $100 per day, the initiation of legal action, or both.
