APPROVAL OF A CERTIFIED SURVEY MAP AND RECOMMENDATION TO COUNCIL FOR A
REZONING FROM EA EXCLUSIVE AGRICULTURAL TO A AGRICULTURAL FOR THE
SONNENTAG PROPERTY LOCATED IN THE SE ¼ OF SECTION 34
(LOOMIS DRIVE / TAX KEY NO. 2296.999.001)
WHEREAS, On May 11, 2004 a Certified Survey Map for a two (2) lot land division and a petition for a
rezoning was submitted by George Sonnentag for a property located in the SE ¼ of Section 34, (Tax Key
No. 2296.999.001 / Loomis Drive), and
WHEREAS, The proposed land division would create lots with minimum areas of approximately 19.5 and
24 acres, and
WHEREAS, Said property is zoned EA Exclusive Agricultural District, requiring an unsewered minimum
lot size of 35 acres and an average minimum width of 1,275 feet and requires a rezoning to A Agricultural
to permit land divisions with a minimum lot size of 120,000 square feet and an average minimum width of
300 feet , and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for Agriculture and Open
Lands, and this proposal is consistent with this goal, and
WHEREAS, Said parcels will receive access from Loomis Drive via a road dedication, although a road
dedication also exists on the southwest corner of Parcel 2, and
WHEREAS, Said parcels will be serviced by private sanitary sewerage facilities and private water supply,
and
WHEREAS, Rights of way have been dedicated in accordance with the 2010 Street System Plan.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map being
submitted creating two parcels and recommends approval for a rezoning from EA Exclusive Agricultural to
A Agricultural on the Sonnentag property located in the SE ¼ of Section 34, subject to resolution of
technical discrepancies as identified by the City Planning Department and City Engineers, and payment of
all applicable fees in Section 18.14(3) of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, Parcel 2 must access off of the Loomis Drive road dedication and will
need a wetland crossing permit when the parcel is to be developed. If Parcel 2 does not get approval
granted over the wetlands for access from the Loomis Drive road dedication it will need to access off the
southwest existing dedication from Union Church Road. This would be the fourth buildable parcel off this
access, thus warranting the need to improve this street to City standards.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in accordance
with Common Council Ordinance No. 1118 and Resolution 196-2002.
