RECOMMENDATION OF APPROVAL OF A PRELIMINARY PLAT, REZONING FROM A
AGRICULTURAL TO RS-2/OPD SUBURBAN RESIDENCE WITH A PLANNED
DEVLOPMENT OVERLAY DISTRICT, AND A 2010 PLAN AMENDMENT FROM
AGRICULTURE AND OPEN SPACE TO MEDIUM DENSITY RESIDENTIAL FOR
WOODLAND CREEK ESTATES LOCATED IN
THE NE ¼ OF SECTION 20 AND NW ¼ OF SECTION 21
(RACINE AVENUE / TAX KEY NOs. 2237.993 AND 2242.994)
WHEREAS, On July 6, 2004 a preliminary plat was submitted by Towne Realty for Woodland Creek
Estates (f.k.a. Hickory Creek) located in the NE ¼ of Section 20 and NW ¼ of Section 21, and
WHEREAS, Said plat proposes 60 single-family lots ranging from approximately 18,000 square feet to
22,000 square feet and three (3) outlots for wetlands protection purposes, and
WHEREAS, Said property is zoned A Agricultural and petitioner requests a rezoning to RS-2/OPD
Suburban Residence District with a Planned Development Overlay District, which requires a minimum lot
size of 20,000 square feet and minimum width of 110 feet, and said proposed plat appears to meet these
requirements, and
WHEREAS, The OPD zoning district allows for increased flexibility within the underlying zoning
requirements and said plat appears to incorporate decreased lot sizes and widths that closely represent the
requirements of the RS-2 district, and
WHEREAS, Said property is shown on the 2010 Land Use Plan as Agriculture and Open Space and
requires an amendment to Medium Density Residential, and said proposed plat appears to meet all
requirements, and
WHEREAS, The Plan Commission has found that the plat is consistent with the adopted 2010 Plan, the
Conservation Plan, the adopted 2003-2007 Park and Open Space Plan, and the 2010 Street System Plan,
and
WHEREAS, Said parcels will be serviced by City sewer and water, and
WHEREAS, Stormwater management will be accommodated on-site.
THEREFORE BE IT RESOLVED, That the Plan Commission recommends, approval to the Common
Council of a 60 lot Preliminary Plat, a rezoning from A Agricultural to RS-2/OPD Suburban Residence
with a Planned Development Overlay District, and a 2010 Plan amendment from Agriculture and Open
Space to Medium Density Residential for Woodland Creek Estates located in the NE ¼ of Section 20 and
the NW ¼ of Section 21 and will be receptive to the submittal of a final plat, subject to resolution of
technical discrepancies as identified by the City Planning Department and City Engineers, and payment of
all applicable fees in Section 18.14 of the Land Division Ordinance and outstanding assessments if
applicable.
BE IT FURTHER RESOLVED, That Plan Commission recommends the plat to Public Works for
determinations of interior trails and emergency access alternatives.
BE IT FURTHER RESOLVED, That a digital file of this Plat shall be submitted to the City in accordance
with Common Council Ordinance No. 1118 and Resolution 196-2002.
