APPROVAL OF BUILDING SITE AND OPERATION PLAN FOR DR. PATRICK CONNELL AT
THE PROPERTY LOCATED IN THE NE ¼ OF SECTION 17
(JANESVILLE ROAD / TAX KEY NO. 2192.976.002)
WHEREAS, Plans were submitted by MSI General for a Building, Site and Operation Plan for an
office for Dr. Patrick Connell at the property located in the NE ¼ of Section 17 on April 13, 2004,
and
WHEREAS, The petitioner is proposing a 3,056 square foot office building, and
WHEREAS, Said property is currently zoned B-2/OPD, Local Service Center District as modified
by the Planned Development Overlay, and said use is a permitted use, and
WHEREAS, The proposal conforms to the bulk requirements of the zoning district with the
exception of the setback, and
WHEREAS, The setback of the building is listed as twenty-five (25) feet and the required setback
for the underlying zoning district B-2 is forty (40) feet, although a reduced setback is allowed in
the OPD Planned Development zoning district with Plan Commission approval, and
WHEREAS, The adopted Conservation Plan does not outline the area for acquisition or
management initiatives, and
WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not propose acquisitions
in the area, and
WHEREAS, The proposal is consistent with the 2010 Street System Plan, and
WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and
WHEREAS, The property is subject to Chapter 34 of the Municipal Code, and stormwater
management will be provided with the stormwater pond located on the Discovery Days Childcare
lot, and
WHEREAS, The facility will have approximately four to five employees and accommodate
approximately 20 to 60 patients on a daily basis, and
WHEREAS, The hours of operation are projected to be 8am to 8pm, Monday through Saturday,
subject to doctor’s schedule and hours, and
WHEREAS, Access to the site will be provided through the existing drives to the west of Kwik
Trip and the cross-access easements from Discovery Days Childcare, and
WHEREAS, Two parking areas are proposed for a total of 17 vehicles, and the number of stalls
appears sufficient for the intended use, and
WHEREAS, Lighting and photometric plans have been submitted for review, and four (4) 70-watt,
high-pressure sodium vapor wall pack fixtures are illustrated on the building, and three, 150-watt,
high-pressure sodium vapor fixtures on a pole is illustrated, and
WHEREAS, The maximum height of the pole, fixture, and base is 15-feet as measured from
grade, and
WHEREAS, A cedar trash enclosure is proposed on-site, and the enclosure will be a color
generally matching the building as required by the General Design Guide, and
WHEREAS, The landscape plan has been reviewed by the City Forester, and revisions are
necessary, and
WHEREAS, No signage is proposed for the development, and all signage must be approved by
staff or, where complications exist, Plan Commission prior to installation.
WHEREAS, The building is subject to the General Design Guide, and the building will be
constructed with architectural block of varying sizes and face textures, and the colors proposed
are a hickory blend for the smaller block and grey for the larger, and a mansard roof with
dimensional shingles wraps around the entire structure, and
WHEREAS, The materials proposed include keystones around windows and doors and gable
vents on either side of the building, while the brick and blocks provide varied textures and
projections for a unique appearance, and
WHEREAS, Mechanicals are not illustrated on the plan, but must be screened from view.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan for Plan for an office building at the property located in the NE ¼ of Section 17.
BE IT FURTHER RESOLVED, The stormwater management, grading, and erosion control plans
must be approved by the City Engineer prior to the release of building permits.
BE IT FURTHER RESOLVED, All disturbed areas on the site are required to be sodded, and
these areas must be illustrated on the landscape plan.
BE IT FURTHER RESOLVED, A revised landscaping plan shall be approved by the City Forester
prior to the release of building permits.
BE IT FURTHER RESOLVED, Cross-Access easements must be recorded and proof delivered
to the Planning Department before the issuance of building permits.
BE IT FURTHER RESOLVED, That the 25-foot setback is allowed by Plan Commission under
the provisions of the OPD Planned Development zoning district due to the fact that the building
will not hamper safety, ample streetscaping arrangements can still be made, and the setback
provides conformance with many new design guides which promote having commercial buildings
closer to the street right-of-ways while providing parking and asphalt areas behind the building
away from public view.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value
of said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
