APPROVAL OF A TWO (2) LOT CERTIFIED SURVEY MAP FOR THE SMART PROPERTY
LOCATED IN THE NW ¼ OF SECTION 4
(TAX KEY NO. 2174.143 / W184 S6668 JEWEL CREST DRIVE)
WHEREAS, On February 24, 2004 a Certified Survey Map was submitted by Roy Smart for a two
(2) lot land division of property located in the NW ¼ of Section 4, and
WHEREAS, legal lot status was approved for this parcel by Plan Commission as per Resolution#
069-2002 on May 21, 2002,and
WHEREAS, the Committee of the Whole found on January 8, 2004 that the petitioner could
proceed with a CSM even though the original time frame had expired, and
WHEREAS, The proposed land division would create lots with an average area of 6,953 square
feet and average widths of 50 feet, and
WHEREAS, Said properties are zoned RS-3 / OLS Suburban Residence District with Lakeshore
Overlay District requiring a minimum lot size of 10,000 square feet and an average minimum
width of 67 feet, and said parcels do not meet said minimum zoning requirements for lot size and
width, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for medium
density residential development and this proposal is within this goal, and
WHEREAS, Said parcels will be serviced by municipal sanitary sewer and private water, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey Map
being submitted creating a two (2) lot land division of the Smart property located in the NW ¼ of
Section 4 subject to resolution of technical discrepancies as identified by the City Planning
Department and City Engineers and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That the approval is based solely on the prior submittal and
approval of Legal Lot Status at the May 21, 2002 Plan Commission meeting.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in
accordance with Common Council Ordinance No. 1118.
