APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDITIONAL USE GRANT
FOR A DAY CARE CENTER FOR LEAPS AND BOUNDS CHILD CARE IN THE MUSKEGO
CENTRE PLANNED DEVELOPMENT DISTRICT AT THE
PROPERTY LOCATED IN THE SE ¼ OF SECTION 8

WHEREAS, Plans were submitted by Berg Construction for a Building, Site and Operation Plan
and Conditional Use Grant for Leaps and Bounds Day Care Center in the Muskego Centre
Planned Development District at the property located in the SE ¼ of Section 8 on March 4, 2004,
and
WHEREAS, The petitioner is proposing to fill a 4,800 square foot vacancy in the Muskego Centre
for a day care building, and
WHEREAS, Said property is currently zoned B-2/OPD, Local Service Center District as modified
by the Planned Development Overlay, and said use is a permitted use by Conditional Use Grant,
and a public hearing has been scheduled before the Plan Commission on April 20, 2004, and
WHEREAS, The proposal conforms to the bulk requirements of the zoning district, and
WHEREAS, The adopted Conservation Plan does not outline the area for acquisition or
management initiatives, and
WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not propose acquisitions
in the area, and
WHEREAS, The proposal is consistent with the 2010 Street System Plan, and
WHEREAS, Said parcel will be serviced by municipal sanitary sewer and municipal water, and
WHEREAS, The outdoor modifications amending the existing BSO Plan for the Muskego Centre
Development entail adding a 6-foot high chain-link fence in a 360 square foot area at the rear of
the building, and
WHEREAS, The outdoor modifications also entail adding paint striping along the existing
pavement to be utilized as a crosswalk for children to access the playground facilities, and
WHEREAS, The children will be walked across the striped area only to ensure their safety while
crossing, and
WHEREAS, There will be two teachers outside during all outdoor play time, and
WHEREAS, One teacher will have a two way radio with them at all outdoor times with an
additional two way with either the Director or Administrator, which will enable communication
between the playground and building at all play times, and
WHEREAS, The outdoor modifications also entail a 2,400 square foot playground facility that will
be surrounded by a chain-link fence, and
WHEREAS, Children will never be permitted to go from the playground into the building without a
teacher or staff member, and
WHEREAS, The grading plan for the approved Muskego Centre Development will remain
unaffected, and
WHEREAS, A copy of the preliminary State license accompanies the supplement and shows
conformity, and
WHEREAS, The building is proposed for approximately 75 children, ages six weeks through
eleven years, and
WHEREAS, The hours of operation are projected to be 6am to 6pm, Monday through Friday, and
WHEREAS, Access to the site will be provided through the existing drives off of Racine Avenue
to the Muskego Centre, and
WHEREAS, Signage is proposed for the development consisting of white channeled lettering that
is internally luminated by red LED, the signage consists of approximately 50 square feet and the
front elevation of the building is approximately 1,054 square feet which results in conformity with
the 5% requirement of the zoning district.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building, Site and
Operation Plan and Conditional Use Grant for Leaps and Bounds Child Care located in the SE ¼
of Section 8.
BE IT FURTHER RESOLVED, State licensing is required as part of approvals.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspects of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of outdoor
amenities, a bond, letter of credit or cashiers check equal to twice the value of said costs must be
submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
