APPROVAL OF A CERTIFIED SURVEY MAP FOR THE LAWLER PROPERTY LOCATED
IN THE SW ¼ OF SECTION 1
(S69 W13830 TESS CORNERS DRIVE / TAX KEY NO. 2163.998.001)
WHEREAS, On November 6, 2003 a Certified Survey Map was submitted by Ron Lawler for a
three(3) lot land division located in the SW ¼ of Section 1, (Tax Key No. 2163.998.001 / S69
W13830 Tess Corners Drive, and
WHEREAS, On October 7, 2003 a sketch land division was approved by Resolution #PC 127-
2003, and
WHEREAS, The proposed land division would create lots with a minimum area of approximately
37,492 square feet and an average minimum width of approximately 190 feet, and
WHEREAS, Said property is zoned RS-2 Suburban Residence District, requiring a minimum lot
size of 20,000 square feet and an average minimum width of 110 feet, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for medium
density residential development, and this proposal is consistent with this goal, and
WHEREAS, Said parcels will be serviced by public sanitary sewer and private water supply, and
WHEREAS, Parcel 2 includes an agricultural building which is eligible for Rustic Structure
designation, and absent of application and grant of Rustic Structure Status, said structure will be
required to be removed, and
WHEREAS, Rights of way have been dedicated in accordance with the 2010 Street System Plan.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Certified Survey
Map being submitted creating three parcels on the Lawler property located in the SW ¼ of
Section 1, subject to resolution of technical discrepancies as identified by the City Planning
Department and City Engineers, and payment of all applicable fees in Section 18.14(3) of the
Land Division Ordinance and outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That absent of application and grant of Rustic Structure
designation, the agricultural building on Parcel 2 shall be removed within twelve (12) months of
the recording of the Certified Survey Map.
BE IT FURTHER RESOLVED, That a digital file of this CSM shall be submitted to the City in
accordance with Common Council Ordinance No. 1118 and Resolution 196-2002.
