REAPPROVAL OF A TWO (2) LOT SKETCH LAND DIVISION FOR THE
SWITALA PROPERTY LOCATED IN THE NE ¼ OF SECTION 15
(TAX KEY NO. 2217.947.001 / W163 S8025 CONICAL LANE AND TAX KEY NO.
2217.947 / W163 S7921 BAY LANE PLACE)
WHEREAS, On May 3, 2001 a sketch land division was submitted by Frank Switala for
a two (2) lot land division of the Switala property located in the NE ¼ of Section 15,
(Tax Key No. 2217.947.001 and Tax Key No. 2217.947), and
WHEREAS, Said sketch was approved by the Plan Commission on May 15, 2001, and
said approvals expired on November 15, 2002, and
WHEREAS, On October 14, 2003 petitioner applied for reapproval, and
WHEREAS, The proposed land division would create lots with a minimum area of
30,190 square feet and an average minimum width of 125 feet, and
WHEREAS, Said properties are zoned RS-3 / OED Suburban Residence District with
Existing Development Overlay District, requiring a minimum lot size of 11,250 square
feet and an average minimum width of 75 feet, and RS-3 / OLS Suburban Residence
District with Lakeshore Overlay District requiring a minimum lot size of 10,000 square
feet and an average minimum width of 67 feet, and said parcels meet said minimum
zoning requirements for lot width, and
WHEREAS, The 2010 Comprehensive Plan depicts this area as being set aside for
medium density residential development and this proposal is within this goal, and
WHEREAS, Said parcels will be serviced by municipal sanitary sewer and private water,
and
WHEREAS, The westerly parcel boundary abuts the private roadway known as Sobek
Lane.
THEREFORE BE IT RESOLVED, That the Plan Commission approve of a sketch land
division creating a two (2) lot land division of the Switala property in the NE ¼ of
Section 15.
BE IT FURTHER RESOLVED, That the westerly 30 feet of the parcel known as Tax
Key No. 2217.947.001 shall be dedicated for right-of-way purposes for a minimum
length of 262 feet from the northern property boundary.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and final
action is only an indication of the current intent of the Plan Commission; Final submittals
are subject to future review and consideration by the Plan Commission, municipal
committees of jurisdiction, and other agencies, and approval of final plans is not
guaranteed by this action of the Plan Commission.
