RESOLUTION #P.C. 132-2003
APPROVAL OF AN ACCESSORY STRUCTURE FOR THE DUVE PROPERTY LOCATED IN
THE NE ¼ OF SECTION 33 (TAX KEY NO. 2290.995.003 / W187 S10518 Kelsey Drive)
WHEREAS, On September 24, 2003 a site plan and construction information was submitted by
Robert Duve to construct a 4,320 square foot accessory structure at the property located at W187
S10518 Kelsey Drive, and
WHEREAS, The property is zoned R-1, Country Home District, and where said structure is a
permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C.1, and
WHEREAS, The total square footage for accessory structures is limited to 4,940 square feet of
total square footage of accessory buildings, and said proposal meets the bulk requirements of the
Zoning Code, and
WHEREAS, No outbuildings currently exist on the parcel,
WHEREAS, The structure is proposed to be constructed with grey steel siding with a 42” field
stone wainscoting on the street elevation; charcoal grey steel roof with one foot eaves; and white
service doors and overhead doors, and said proposal does not meet the Plan Commission’s
standards for administrative approval of residential accessory structures, as the wall and roof
materials do not match the materials used on the residence, and
WHEREAS, The colors proposed match the colors of the residence.
WHEREAS, The property is located in a primarily agricultural area.
THEREFORE BE IT RESOLVED, That the Plan Commission approves a 4,320 square foot
accessory structure for the Duve property at W187 S10518 Kelsey Drive in accordance to Section
4.05 (1) B and 6.11 (2).
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the
approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation
of legal action, or both.
