APPROVAL OF BUILDING SITE AND OPERATION PLAN AND CONDOMINIUM PLAT
FOR PHASED DEVELOPMENT OF THE CANDLEWOOD VILLAGE CONDOMINIUMS
AND DETERMINATION OF SUBSTANTIAL CHANGE TO THE APPROVED MRED
PLANNED DEVELOPMENT DISTRICT LOCATED IN THE SW ¼ OF SECTION 2 AND
NW ¼ OF SECTION 11 (MOORLAND ROAD / TAX KEY Nos. 2167.995.016, 2167.995.017,
AND 2167.995.018)
WHEREAS, Building Site and Operation Plans and a Condominium Plat were submitted by
Redmond Development d/b/a MRED (Moorland / Residential) Associates LP, for a Building, Site
and Operation Plan for a 102 unit condominium development located in the SW ¼ of Section 2
and the NW ¼ of Section 11, and
WHEREAS, Said property is currently zoned RSA – OPD Attached Single Family Residence
District with Planned Development Overlay District, and said use is a permitted use by right
subject to Plan Commission and Common Council review and consideration of a Substantial
Change to the planned development district, and
WHEREAS, A Substantial Change public hearing is scheduled for May 27, 2003, and
WHEREAS, The proposal includes fifty-one (51) structures, each being a side-by-side ranch
duplex constructed in one of three architectural styles referred to as the “Tallgrass”, the
“Wildflower”, and the “Goldenrod”, and
WHEREAS, Said structures are proposed to be constructed with Arts & Crafts architectural
detailing, and said structures are consistent with the Moorland South Design Guide, and
WHEREAS, The proposal includes a Commons Building for use by condominium owners, to be
constructed with Arts & Crafts architectural detailing, and said building is consistent with the
Moorland South Design Guide, and
WHEREAS, Each condominium unit is provided with four (4) off street parking spaces, and
WHEREAS, The condominium includes sixty-two (62) parking stalls in common areas for visitor
and overflow parking, and
WHEREAS, The adopted Conservation Plan does not depict any acquisition or management
priorities on the property, and
WHEREAS, The adopted 2003-2007 Park and Open Space Plan does not depict any active park
use of the property, but includes recreation trail components which are incorporated into the
proposal, and
WHEREAS, A landscape plan has been submitted and is addressed separately by the Plan
Commission by Resolution #PC 055-2003, and
WHEREAS, The proposal includes both public and private streets, and all streets are consistent
with the street width requirements depicted on the 2010 Street System Plan, and are consistent
with construction specifications approved by the Public Works Committee, and
WHEREAS, The proposed condominiums will be served by municipal sanitary sewer and water
service, and
WHEREAS, The proposal is subject to Developers Agreements to be executed by the City and
petitioner to address the construction of public and private improvements, and
WHEREAS, All infrastructure is proposed to be constructed in one phase, but condominium
platting and building construction is anticipated to occur in multiple phases, and
WHEREAS, Portions of the property located east of Moorland Road accommodate storm water
on site, said plans have been approved by the Public Works Committee and are subject to
petitioner’s execution of maintenance agreements, and
WHEREAS, Portions of the property located west of Moorland Road are proposed to convey
stormwater to a regional pond previously constructed on lands owned by the City, and plans have
been approved by the Public Works Committee and are subject to petitioner’s execution of
maintenance agreements, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves of the Building Site and
Operation Plan and Condominium Plat for Candlewood Village submitted by Redmond
Development d/b/a MRED (Moorland / Residential) Associates LP located in the SW ¼ of
Section 2 and the NW ¼ of Section 11.
BE IT FURTHER RESOLVED, That the Plan Commission finds the Building Site and Operation
Plan and Condominium Plat for Candlewood Village to be a substantial change requiring a Public
Hearing prior to Common Council approval.
BE IT FURTHER RESOLVED, That the Plan Commission approved of the phased development
of the Condominium Plat, and only requires further review of plat additions where the Planning
Department finds that such additions are inconsistent with the Site Plans approved by this
Resolution.
BE IT FURTHER RESOLVED, That further Plan Commission approval of a Building Site
and Operation Plan and determination of nonsubstantial change is required for structures
having exposed basements.
BE IT FURTHER RESOLVED, That prior to release of building permits, Plan Commission
approval of Tallgrass elevations will be required.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall be
maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value
of said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
