APPROVAL OF AN AMENDMENT TO THE BUILDING, SITE AND OPERATION PLAN FOR ROMERO’S
MARTINI LOUNGE (F.K.A. BANGKOK CAFE) LOCATED IN THE SE ¼ OF SECTION 9 (W172 S7505
LANNON DRIVE / TAX KEY NO. 2193.069)
WHEREAS, On May 19, 2003 plans were submitted by Richard Romero for a Building, Site and
Operation Plan for the property formerly operated as the Bangkok Cafe restaurant located in the SE ¼ of
Section 9, and
WHEREAS, The property is zoned B-4 / OED, Highway Business District with the Existing Development
Overlay, and the restaurant and tavern use is in conformance with the requirements of said zoning
district, and the apartment use on the second floor is nonconforming, and
WHEREAS, The residential units on the second floor of the building were granted an automatic
conditional use grant with the adoption of the City’s Zoning Code in 1964, and
WHEREAS, The petitioner proposes to install a new entrance on the west building elevation, new
windows on the south elevation, replace existing windows on the east elevation, and install a new railing
on the ADA accessibility ramp on the north elevation, and
WHEREAS, No new signage is proposed with this submittal, and all new signage shall be approved by
the Plan Commission, and
WHEREAS, No refuse / dumpster enclosure exists on the property, and the Downtown Design Guide
requires that the enclosure be constructed from materials similar to the building, and
WHEREAS, The Zoning Code requires 37 parking stalls, and the paved parking area will accommodate
18 parking stalls, and
WHEREAS, An unpaved parking area is available along Center Drive, and its capacity is unknown at this
time, and
WHEREAS, The petitioner has indicated the intention to pave the parking area on Center Drive at an
unspecified time in the future.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a Building, Site and Operation
Plan for Romero’s Martini Lounge at the property located at W172 S7505 Lannon Drive.
BE IT FURTHER RESOLVED, That in lieu of a brick dumpster enclosure that the petitioner construct a
cedar enclosure, and a construction detail and site plan shall be provided to the Planning Department
prior to the issuance of building permits for exterior alterations.
BE IT FURTHER RESOLVED, That a striping shall be provided to the Planning Department prior to the
issuance of building permit for parking area along Lannon Drive, and the parking area shall be striped
prior to occupancy.
BE IT FURTHER RESOLVED, The Zoning Code requires all parking areas accommodating more than
four vehicles to be paved, and the Center Drive parking area shall be paved within one year of the date of
this approval.
BE IT FURTHER RESOLVED, The paving and striping of the Center Drive parking area shall require
Plan Commission approval of a Building Site and Operation Plan amendment.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building Department and
that all aspect of this plan as they relate to landscape areas and drainage shall be maintained in
perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of landscaping
and/or asphalting, a bond, letter of credit or cashiers check equal to twice the value of said costs must be
submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this resolution shall
result in the imposition of fines of $100 per day, the initiation of legal action, or both.
