APPROVAL OF FINAL PLAT FOR BIG MUSKEGO ESTATES BY TOWNE
REALTY, LOCATED IN THE SE ¼ AND SW ¼ OF SECTION 13
(TAX KEY NO. 2211.999)
WHEREAS, On March 28, 2003 a final plat was submitted by Towne Realty, Inc. d/b/a
Homes By Towne of Big Muskego Estates LLC for the Benke-Schweitzer property
located in the SE ¼ and SW ¼ of Section 13, and
WHEREAS, The plat consists of approximately 92 acres, proposes 54 parcels, and
provides approximately 49 acres of common open space, and
WHEREAS, Said property was conditionally rezoned to RS-2/OPD Suburban Residence
District and Planned Development Overlay District, with SW Shoreland Wetland
District, by Council Ordinance 1090 on January 22, 2002, and
WHEREAS, The 2010 Comprehensive Plan depicts this area for residential development
at a density not to exceed one dwelling unit per acre, and the plat illustrates a density of
0.55 dwelling units per acre, and
WHEREAS, Said parcels will be serviced by City sewer and water, and
WHEREAS, The 2010 Street System Plan depicts Durham Drive to have a 100 foot wide
ultimate width, and the proposal is consistent with the Plan, and
WHEREAS, Wetlands, floodplain, and shoreland wetlands exist on the property and have
been properly depicted on the Final Plat, and
WHEREAS, The Conservation Plan depicts the wetlands, floodplain, and shoreland
wetlands as a high management priority, and
WHEREAS, The lands west of Durham Drive are proposed to remain in common open
space subject to a Conservation Easement granted to the City of Muskego, and said lands
are within the project boundary of the Big Muskego Lake Wildlife Area, and their
preservation will further the goals of the Wisconsin Department of Natural Resources
with minimal public investment, and
WHEREAS, The plat is required to provide on-site stormwater management as required
by Chapter 34, and the construction plans accommodate this in conjunction with a
wetland restoration effort on lands west of Durham Drive, and
WHEREAS, Said construction plans divert stormwater from the Root River Watershed to
the Muskego Wind-Lake Priority Watershed, and as a result of this alteration the lands
within the plat are to be included in the Big Muskego Lake / Bass Bay Protection and
Rehabilitation District.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a 92 acre, 54
parcel, final plat of Big Muskego Estates Subdivision for the Benke-Schweitzer property
as proposed by Towne Realty, Inc. d/b/a Homes By Towne of Big Muskego Estates LLC
, being located in the SE ¼ and SW ¼ of Section 13.
BE IT FURTHER RESOLVED, That Street Tree and Landscape Plans shall be approved
by the Plan Commission prior to release of Building Permits.
BE IT FURTHER RESOLVED, That this approval is subject to resolution of technical
discrepancies as identified by the City Planning Department and City Engineers, and
payment of all applicable fees in Section 18.14 of the Land Division Ordinance and
outstanding assessments if applicable.
BE IT FURTHER RESOLVED, That a digital file of this Final Plat shall be submitted to
the City in accordance with Common Council Ordinance No. 1118 and Resolution 196-
2002.
