RESOLUTION #P.C. 047-2003
APPROVAL OF A BUILDING SITE AND OPERATION PLAN FOR THE SMITH PROPERTY
LOCATED IN THE SW ¼ OF SECTION 17

WHEREAS, Plans were submitted on April 4, 2003 by Lehrmann Moesch Construction, Inc.
requesting approval of a Building Site and Operation Plan for the Smith property located in the
SW ¼ of Section 17, and
WHEREAS, The submittal included architectural elevations of the proposed structure, and a site
plan, and
WHEREAS, The structure measures approximately 6,160 square feet to accommodate Smith and
Sons, Inc. masonry contracting business, and
WHEREAS, The proposed structure meets the setback, offset, open space, and floor area
requirements of the Zoning Code for structures in the I-1, Industrial Park District, and
WHEREAS, The 2010 Comprehensive Plan depicts the property to be utilized for industrial
purposes, and the proposal is consistent with the Plan, and
WHEREAS, The property is subject to the provisions of the Muskego Design Guide, which has
been duly adopted as a component of the 2010 Comprehensive Plan, and the provisions of said
Guide include but are not limited to the requirement for four sided architecture, and
WHEREAS, The elevations include the use of rib masonry, architectural block, metal seam wall
panels, and standing seam roof, and
WHEREAS, The elevation facing Saturn Drive is constructed entirely with masonry, and the
elements wrap-around both the east and west elevations, and a 7.5-foot “wainscoting” extends
the length of the east and west elevations, and no masonry is proposed on the south elevation,
and
WHEREAS, The colors to be utilized in construction have not been indicated, and
WHEREAS, The Muskego Design Guide requires all mechanical installations to be screened from
public view, and this submittal does not identify the location or screening mechanisms to be
utilized, and
WHEREAS, The site currently provides an asphalt parking area for twelve (12) vehicles (including
handicapped stalls), and the Zoning Code indicates that one parking stall per two employees
must be provided, and
WHEREAS, Parking of business vehicles, trucks, and machinery is proposed inside the building
or in the fenced storage area (measuring 100’ x 175’) to the south of the building, and the plans
indicate a 6’ to 8’ high chain-link fence with red wood lathe inserts, and
WHEREAS, A landscaping plan has been submitted, and said plans require modifications to meet
City Standards pursuant to the City Forester’s April 7, 2003 review, and
WHEREAS, One (1) wall pack lighting fixture is proposed on the south elevation, and the fixture
is a 400-watt, cut-off, down-cast type, high-pressure sodium lamp mounted 15-feet above grade,
and
WHEREAS, One (1) wall pack lighting fixture is proposed at the front entrance, and the fixture is
a 150-watt, cut-off, down-cast type, high-pressure sodium lamp mounted 15-feet above grade,
and
WHEREAS, A monument sign measuring 4’8” in height and 32 square feet in area is proposed
and is in conformance with municipal code requirements, and
WHEREAS, The plan does not indicate the location of refuse containers, and
WHEREAS, Stormwater management plans have been submitted at this time, and are under
review by the City Engineer and the Public Works Committee for compliance with Chapter 34.
THEREFORE BE IT RESOLVED, That the Plan Commission approves a Building Site and
Operation Plan for the Smith property located in SW ¼ of Section 17.
BE IT FURTHER RESOLVED, That a revised landscape plan shall be submitted for Plan
Commission review and approval prior to receipt of building permits.
BE IT FURTHER RESOLVED, That stormwater management plans shall be approved prior to
receipt of building permits.
BE IT FURTHER RESOLVED, That all mechanicals serving the site and / or structure shall be
screened from public view.
BE IT FURTHER RESOLVED, That all waste and refuse containers shall be kept within the
fenced enclosure and shall be screened from public view.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas and drainage shall
be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That if occupancy is requested prior to the completion of
landscaping and/or second lift of asphalting, a cash bond, letter of credit, or cashiers check equal
to twice the value of said costs must be submitted to the Planning Department.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in this
resolution shall result in the imposition of fines of $100 per day, the initiation of legal action, or
both.
THEREFORE BE IT FURTHER RESOLVED, That one parking stall will be allowed in the
front of the building. This stall will be designated as Handicap Parking.
