APPROVAL OF A SKETCH LAND DIVISION FOR THE WERNETTE
PROPERTY LOCATED IN THE NE ¼ OF SECTION 12
(TAX KEY NO. 2205.041)
WHEREAS, On February 20, 2003 a sketch for a four (4) lot land division was
submitted by Thomas Wernette for the property located in the NE ¼ of Section
12, and
WHEREAS, The property is currently zoned RS-2 Suburban Residence District,
requiring a minimum lot size of 20,000 square feet and an average minimum
width of 110 feet, and the parcels appear to meet this requirement, and
WHEREAS, The proposal will be serviced by City sewer and private water, and
WHEREAS, The 2003-2007 Park and Open Space Plan does not depict
acquisitions in this area, and
WHEREAS, The Conservation Plan does not depict acquisition or management
priorities in this area, and
WHEREAS, Tess Corners Drive and Flintlock Trail have been dedicated to their
ultimate width as depicted on the 2010 Street System Plan, and
WHEREAS, The parcel is bisected by a navigable waterway and it is the opinion
of the Wisconsin Attorney General that “a river, stream, or creek that crosses a
parcel legally divides said parcel as a highway would,” and therefore outlots must
be created for the portions located east of the navigable water way, and
WHEREAS, The parcel is located in Zone B of the National Flood Insurance Rate
Maps, and the petitioner must demonstrate that the lowest floor elevations of
structures will be at least three (3) feet above flood elevations, and that site
disturbing activities will not alter flood elevations by more than 0.01 feet.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of a four
(4) lot sketch land division as submitted by Thomas Wernette for the property
located in the NE ¼ of Section 12 and will be receptive to the submittal of a
Certified Survey Map.
BE IT FURTHER RESOLVED, That a grading and drainage plan is required to
be approved by the Public Works Committee, Department of Natural Resources,
and Army Corps. of Engineers prior to submittal of the final Certified Survey Map.
BE IT FURTHER RESOLVED, That this approval is granted in concept only and
final action is only an indication of the current intent of the Plan Commission;
Final submittals are subject to future review and consideration by the Plan
Commission, municipal committees of jurisdiction, and other agencies, and
approval of final plans is not guaranteed by this action of the Plan Commission.
