APPROVAL OF TWO 10 x12 ACCESSORY STRUCTURES FOR
THE LARRY & LINDA DOMNICK PROPERTY LOCATED AT
W 152 S7917 MYSTIC DRIVE.
WHEREAS, A site plan and construction information was submitted on December 4,
1998 by Linda Domnick to construct two IO X 12 (120 square foot) accessory structures at the
Larry & Linda Domnick property located at W152 S7917 Mystic Drive, and
WHEREAS, The property is zoned RS-2 Suburban Residence District, and where said
structures are a permitted accessory use and subject to Plan Commission review per Section 4.05
(2) C.1, and
WHEREAS, The total square footage for accessory structures is limited to 60% of the
total first floor primary habitable area and this residence contains a total of 1,472 square feet
which would allow 883 square feet of total square footage of accessory buildings, and
WHEREAS, No outbuildings exist on the parcel, and
WHEREAS, The location of the structures maintain all necessary offsets and setbacks, the
ultimate height is limited to 15 feet, and the architectural appearance would be compatible with
the applicant’s surrounding area, and the materials submitted do not propose the use of this nor
any other structure on the property for business related activities. 0
THEREFORE BE IT RESOLVED, That the Plan Commission approves of two 10 X 12
(120 square feet) sued structures for the Donmick property at W152 S7917 Mystic Drive in
accordance to Section 4.05 (2) C. 1 and 6.11 (2) and that subject accessory structures not be used
for the operation of a business nor the storage of business related material or equipment.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per violation, the
initiation of legal action, or both.
