APPROVAL OF A CONCEPTUAL SITE AND OPERATION PLAN FOR AN
INDEPENDENT CREMATION SERVICE FOR PHILLIP PASSON AND LARRY COMPTON
AT THE PROPERTY LOCATED AT W190 S8140 MERCURY DRIVE a
WHEREAS, The concept has been proposed by Phillip Passon and Larry Compton to
locate a human cremation service at W190 S8140 Mercury Drive as described in a letter
submitted to the City on November 5, 1998, and
WHEREAS, The existing property contains an industrial building formally used as office
and warehouse for a construction company, and
WHEREAS, The property is zoned 1-1 Industrial Park District and the proposed use is not
specifically classified in the Zoning Ordinance, and
WHEREAS, Section 17:5.01(3) Unclassified Uses allows the Plan Commission to make a
determination as to the proper treatment of an unclassified use.
THEREFORE BE IT RESOLVED, That the Plan Commission finds that a cremation
service solely intended for the incineration of human corpses is hereby classified as a permitted
use by right in the 1-1 Industrial Park District (no incineration of garbage, medical wastes or
industrial wastes).
BE IT FURTHER RESOLVED That the Plan Commission approves the site and
operation plan for a human cremation service at the property located at W190 S8140 Mercury
Drive as presented in the November 5, 1998 submittal of Phillip Passon and Larry Compton.
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas building facades and
drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in
this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
