RESOLUTION 8P.C. 187-98
APPROVAL OF A MOTHER-IN-LAWFAMILY UNIT FOR HYKE PROPERTY LOCATED
AT LOT #24 IN THE PARK ESTATES SUBDIVISION
(NORTH OF W204 S8208 PASADENA DRIVE)
WHEREAS, Plans were submitted on October 21, 1998 by David and Goliath Builders for
a building, site and operation plan for a mother-in-law/family unit for Charles and Debra Hyke
located at Lot #24 of the Park Estates subdivision, just north of W204 S8208 Pasadena Drive,
and
WHEREAS, Said property is cunently zoned RS-UOPD, Suburban Residence with an
overlay of Planned Development District, and said use is a permitted accessory use subject to
certain criteria. and
WHEREAS, It is proposed to construct a single family residence with a mother-in-law
unit totaling 781 square feet consisting of a bedroom, full bathroom, full kitchen, a great room,
access to a garage with a service door, and access to a partitioned basement area containing
facilities for a potential full bathroom, and
WHEREAS, Section 17:8.01(7)B. 14 establishes standards for mother-in-law/family units
such that, among other criteria, the mother-in-law unit may consist of" .a kitchen, bath den and
bedroom. " plus " .access to a garage having no service door" and this proposal is not in
compliance with these standards. e THEREFORE BE IT RESOLVED, That the Plan Commission approves of the building,
site and operation plan submitted on October 21, 1998 by David and Goliath Builders for a
Mother-In-LawFamily unit for Charles and Debra Hyke located at Lot #24 of the Park Estates
subdivision, just north of W204 S8208 Pasadena Drive.
BE IT FURTHER RESOLVED, That no independent access from the mother-in-
law/family unit to the basement area shall be permitted (eliminate stairs from MIL unit to
basement area), no service door on the garage shall be permitted (eliminate service door), no
lockable doors are permitted in the common foyer, and detailed grading and drainage plans for the
exposed basement will be submitted for City Engineer review prior to application for a building
permit.
BE IT FURTHER RESOLVED, That failure to comply with the approval contained in
this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
