RECOMMENDATION OF APPROVAL TO REZONE 21 ACRES OF THE NORTH CAPE
FARMS, INC.,(PlPKE) PROPERTY FROM R-3, COUNTRY HOME TO RSE/OPD,
SUBURBAN ESTATES WITH A PLANNED DEVELOPMENT OVERLAY DISTRICT
LOCATED IN THE SE '/i OF SECTION 13
(TAX KEY NO. 2212.999.001 OR W126 S8662 NORTH CAPE ROAD)
WHEREAS, A petition for rezoning was submitted October 15, 1998 by Alfred and
Joanne Pipke to rezone property to RSE/OPD Suburban Estates with a Planned Development
Overlay District, and
WHEREAS, The total area to be rezoned would include approximately 21.086 acres to
allow for a single family 22 lot development, and
WHEREAS, On July 7, 1998, the Plan Commission, under Resolution #P.C.127-98,
approved a sketch preliminary plat for an OPD development for North Cape Farms, Inc. having
24 single family lots ranging in size from 20,112 square feet to 40,137 square feet, all contained
within 23.1 acres of land to be zoned RSE/OPD, and
WHEREAS, The subject rezoning petition encompasses 21.086 acres of land which will
support lots 1 through 22 as illustrated on the preliminary plat as recommended for approval by
the Plan Commission on October 20, 1998 through resolution #P.C. 166-98; said lots ranging in 0 size from 20, 112 square feet to 30,561 square feet, and
WHEREAS, A Public Hearing for the rezoning has been scheduled before the Common
Council onNovember 10, 1998, and
WHEREAS, The adjacent properties are zoned as follows: R-3 to the East in the City of
Franklin, RSE to the North, R-2 to the West, and RSE to the South, and
WHEREAS, The City of Muskego Land Use Plan for the Year 2005 anticipates use in this
specific area as being low density residential development and this proposal is in compliance.
THEREFORE BE IT RESOLVED, That the Plan Commission does hereby recommend
approval to the Common Council for the rezoning of approximately 21.086 acres to be rezoned to
RSEIOPD Suburban Estate to allow for a 22 lot single family subdivision.
