APPROVAL TO MAINTAIN A 25’ X 29’ ACCESSORY STRUCTURE FOR
THE SPRYSL PROPERTY LOCATED AT W186 S6820 JEWEL CREST DFUVE
WHEREAS, A site plan and construction information was submitted on September 30,
1998, by Wallace Homes, Inc. to build an attached garage to a parcel with an existing accessory
building, and

WHEREAS, The petitioner would like to maintain a 25’ X 29’ (725 square foot)
accessory structure at the Sprysl property located at W186 S6820 Jewel Crest Drive, and
WHEREAS, The property is zoned RS-3/0LS, Suburban Residence District with a Lake
Shore Overlay, and where said structure is a permitted accessory use and is now considered a
second garage structure subject to Plan Commission review per Section 4.05 (2) C. 1, and
WHEREAS, The total square footage for accessory structures is limited to 60.0% of the
total first floor habitable area, and the residence contains a first floor area of 1,367 square feet
which would allow 820 square feet of accessory buildings, and
WHEREAS, The location of the structure does not maintain all necessary offsets and
setbacks, the ultimate height is limited to 15 feet, the architectural appearance would be
compatible with the applicant’s surrounding area, and the materials submitted do not propose the
use of this nor any other structure on the property for business related activities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of no more than
725 square feet of accessory buildings for the Sprysl property at W 186 S6820 Jewel Crest Drive
in accordance to Section 4.05 (1) B and 6.11 (2) and that subject accessory structure not be used
for the operation of a business nor the storage of business related material or equipment.
BE IT FURTHER RESOLVED, That within 12 months, subject structure shall be
relocated on the property to conform to the side and rear yard offset requirements of the zoning
district, and within 12 months the new home is constructed, otherwise subject structure shall be
razed.
BE IT FTJRTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per violation, the
initiation of legal action, or both.
THEREFORE BE IT FURTHER RESOLVED, That the garage shall remain as an
existing nonconformance structure on property to be razed if the new residence is not constructed
within 12 months.
