RESOLUTION #P.C. 137-98
APPROVAL OF A 26’ X 35.5’ ACCESSORY STRUCTURE FOR
THE DE ANGEL0 PROPERTY LOCATED AT W 126 S6384 COLERIDGE COURT
WHEREAS, A site plan and construction information was submitted on Iuly 24, 1998, by
Mike De Angelo to construct a 26 X 35.5 foot (923 square foot) accessory structure at the De
Angelo property located at W 126 S6384 Coleridge Court, and
WHEREAS, The property is zoned RS-2, Suburban Residence, and where said structure
is a permitted accessory use and subject to Plan Commission review per Section 4.05 (2) C. 1, and
WHEREAS, The total square footage for accessory structures is limited to 60% of the
total first floor primary habitable area and contains 1,548 square feet which would allow 929
square feet of total square footage of accessory buildings, and
WHEREAS, No outbuildings exist on the parcel and approval of proposed structure
would allow a fUture accessory structure (including, but not limited to, a garage, shed, gazebo,
etc.) limited to 6 square feet, and
WHEREAS, The location of the structure maintains all necessary offsets and setbacks, the
ultimate height is limited to 15 feet, the architectural appearance would be compatible with the
applicant’s surrounding area, and the materials submitted do not propose the use of this nor any e other structure on the property for business related activities.
TKEREFORE BE IT RESOLVED, That the Plan Commission approves of a compatible
size structure not exceeding 923 square feet, and placed in accordance with ordinance defined
offset requirements, for the De Angelo property at W126 S6384 Coleridge Court in accordance
to Section 4.05 (1) B and 6.11 (2) and that subject accessory structure not be used for the
operation of a business nor the storage of business related material or equipment.
BE IT FURTHER RESOLVED, That the Plan Commission approves a maximum 26’ x
28’ structure, landscaping as proposed on site plan, no additional driveway to garage, lot drainage
to be reviewed by st&, concrete brick pattern decorative with paint to match siding and permit to
be issued after City Engineer review and neighbors approval of drainage.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per violation, the
initiation of legal action, or both.
