DIRECTIVE FROM THE PLAN COMMISSION TO CITY STAFF TO ENFORCE, AS
WRITTEN, CHAPTER 17:2.02 (8) BUILDING, HEIGHT OF
WHEREAS, Due to past concerns expressed by the fire companies serving Muskego
regarding fire fighting capabilities, City Zoning Administrators have historically enforce building
height restrictions by measuring from the proposed finished yard grade at the front of the
structure to the peak of the roof, and
WHEREAS, Chapter 17:2.02(8) Building, Height of, defines building height as, “The
vertical distance from the average established street grade in the front of the lot or the average
finished grade at the front building line, whichever is higher, to the highest point of the coping of a
flat roof, to the deck line of a mansard roof, or to the average height of the highest gable of a
gambrel, hip or pitch roof‘, resulting in higher structures than what is permitted under historical
policy, and
WHEREAS, The historical policy of the City Zoning Administrators, and the Ordinance
definition of building height are in conflict.
THEREFORE BE IT RESLOVED, That the Plan Commission directs the City Zoning
Administrator to not continue enforcing the building height restrictions as historically applied. 0 BE IT FURTHER RESOLVED, That the Plan Commission directs the City Zoning
Administrator to amend Chapter 17:2.02 (8) to require that for one and two family
construction, staff measure from the front grade to highest point with multiple peaks
unless appropriate fire access for fire vehicles is provided than use the average height
(as measured between the eave and peak) of the highest peak; always use the average
height of the highest peak for commercial construction; incorporate pictures in the
definitions for better illustration of measurement methods.
