APPROVAL TO MAINTAIN A 20’ X 20’, 11’ X 12’ AND A 12’ X 12’ ACCESSORY
STRUCTURES FOR THE KELPIN PROPERTY LOCATED AT S110 W20468 S DENOON
ROAD
WHEREAS, A site plan and construction information was submitted on May 6, 1998, by
Orendorf Construction to maintain a 20’ x 20’ garage and a 1 I’ x 12’ accessory building and a
12’ x 22’ boat house (totaling 676 square feet of outbuildings) at the Kelpin property located at
SI 10 W20468 S Denoon Road. and
WHEREAS, The property is zoned RS-2/0LS, Suburban Residential with a Lake Shore
Overlay, and where said structures are a permitted accessory use and subject to Plan Commission
review per Section 4.05 (2) C. 1 if there is a primary residence on the parcel, and
WHEREAS, The petitioner is proposing to raze the primary residence and leave the
outbuildings, and
WHEREAS, The total square footage for accessory structures is limited to 60% of the
total first floor primary habitable area and a future home is proposed for the property and would
contain 1,233 square feet which would allow 740 square feet of total square footage of accessory
buildings, and * WHEREAS, The location of all the structures do not maintain necessary offsets from the
west lot line and from the Ordinary High Water Mark, their ultimate height is limited to 15 feet,
the architectural appearance would be compatible with the applicant’s surrounding area, and the
materials submitted do not propose the use of this nor any other structure on the property for
business related activities.
THEREFORE BE IT RESOLVED, That the Plan Commission approves maintaining the
12’ X 12’ boat house for the Kelpin property at SI IO W20468 S Denoon Road in accordance to
Section 4.05 (I) B and 6.11 (2) and that subject accessory structure not be used for the operation
of a business nor the storage of business related material or equipment.
BE IT FURTHER RESOLVED, That if construction of the new residence does not
substantially commence within 12 months of the date of this approval, petitioner shall remove all
remaining structures from the property.
BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution
and the approved site plans shall result in the issuance of fines of $100 per day per violation, the
initiation of legal action, or both and that all appropriate razing permits be obtained.
