APPROVAL OF AMENDMENT TO A BUILDING, SITE AND OPERATION PLAN FOR
THE BUSHBERGER AND KURER PROPERTY LOCATED AT
S67 W 1483 1 JANESVILLE ROAD

WHEREAS, Plans to expand the existing tavern located at S67 W14831 Janesville Road
(Bushy’s Pub) were conceptually approved by the Plan Commission on November 18, 1997,
under Resolution WC. 227-97. and
WHEREAS. Final plans were submitted by Lynn Kurer on December 19, 1997 , and
WHEREAS, The property is zoned B-2, Local Service Center District, and the existing
structure is a legal nonconforming building, located within the ultimate right-of-way of Janesville
Road (CTH L) and within the base setback line of Durham Drive, and
WHEREAS, A majority of the proposed expansion area would be within the conformance
area of the parcel, with the exception of an area located southwest of the existing building, which
has received a variance from the Board of Appeals, and
WHEREAS, The existing building contains 1,260 square feet and the addition would
include 1, 205 feet of seating, restroom, and circulation space, totaling 2,465 square feet, and the
building facade would be substantially modified from its present state.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of an amended
building, site and operation plan for the property located at S67 W14831 Janesville Road, for
Lynn Kurer
BE IT FURTHER RESOLVED, That a copy of said plans be kept on file in the Building
Department and that all aspect of this plan as they relate to landscape areas building facades and
drainage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission.
BE IT FmTHER RESOLVED, That failure to comply with the approval contained in
this resolution shall result in the imposition of fines of $100 per day, the initiation of legal action,
or both.
BE IT FURTHER RESOLVED, That Hold Harmless Agreement be signed. Dumpster to
be relocated to 10 feet from the property line in the southwest corner, Box in two dining area
windows on the east side of building. Parking lot needs to have spaces striped. Parking along
west and south lot lines need to be adjusted to provide a ten foot offset.
BE IT FURTHER RESOLVED, That the amounts for 50% rule be verified and if e amounts are greater than the ruling, a variance would be required.
