RESOLUTION ACCEPTING DEDICATION OF PUBLIC IMPROVEMENTS ALONG
MARTIN DRIVE AND WITHIN THE LINDALE VILLAS CONDOMINIUM
DEVELOPMENT LOCATED WEST OF MARTIN DRIVE
WHEREAS, Lindemann Properties, LLC hereafter called "DEVELOPER" has
constructed the following public improvements: a storm water retention pond located
east of Martin Drive on City owned lot-Tax Key Number 2172.999.001 and Developer
owned lot-Tax key Number 2169.987.006 and sanitary sewer, water main, storm sewer
in Martin Drive, curb and gutter and asphalt pavement in Martin Drive at the following
development:
Parcel 2 and Outlot 2 of Certified Survey map No. 9618, being a part of vacated
Martin Drive and lands in the SW Y4 of the SE Y4 of Section 3, T5N, R20E, in the
City of Muskego, Waukesha County, Wisconsin.
and
WHEREAS, the DEVELOPER has completed the construction and installation of
the following improvements:

491.8 LF at $53/LF of 8" diameter pvc sanitary sewer pipe
4 EACH at $2650/EACH of 48" diameter concrete sanitary sewer manholes
Water Main
1026.7 LF at $40/LF of 8" diameter pvc water main pipe
7 EACH at $1 OOO/EACH of 8" diameter butterfly valves with valve boxes
4 EACH at $850/EACH of 6" diameter butterfly valves on hydrant lead pipe
4 EACH at $3400/EACH of fire hydrants
33 LF at $31/LF of 6" diameter pvc water main lead pipe
7 EACH at $800/EACH of 6" diameter butterfly valves and valve boxes on service
connections
14 LF at $30/LF of 6" diameter pvc water service pipe
Storm Sewer
27.2 LF at $60/LF of 24" diameter reinforced concrete storm sewer pipe
572.7 LF at $46/LF of 18" diameter reinforced concrete storm sewer pipe

and appurtenances (collectively called "IMPROVEMENTS") in accordance with the
provision of Chapter 18 of the Municipal Code of the City of Muskego, hereafter called
the "CITY" and the City Engineer has certified the systems' acceptability; and
WHEREAS, it is the Developer's intent to, without charge to the CITY,
unconditionally give, grant, convey and fully dedicate the IMPROVEMENTS to the
CITY, free and clear of all encumbrances, and together with mains, conduits, pipes,
plants, machinery, equipment and appurtenances, which relate directly to the utilization
of such utilities; and
WHEREAS, the DEVELOPER shall guarantee the public improvements to be
dedicated against any defects due to faulty materials or workmanship which appear
within a period of one (1) year from the date of dedication and shall pay for any
damages resulting therefrom to the CITY property and shall indemnify the CITY against
any claims, suits, or liabilities brought against the CITY at any time arising out of the
alleged defects or other failure of this guarantee.
NOW, THEREFORE, BE IT RESOLVED that the Common Council of the City of
Muskego hereby accepts the dedication of the public improvements.

DEDICA nON OF PUBLIC IMPROVEMENTS
FOR LINDALE VILLAS CONDOMINIUMS
Lindemann Properties II, LLC (Developer) in accordance with the Lindale Villas Condominium
Development Agreement hereby, without charge to the City of Muskego (City), gives, grants, conveys
and fully dedicates to the City on behalf of and for the benefit of the public for public use the public
street improvements on Martin Drive, the storm water retention pond located east of Martin Drive on
City owned lot-Tax Key Number 2172.999.001 and Developer owned lot-Tax Key Number
2169.987.006 and sanitary sewer, water main and storm sewer facilities, including any and all
equipment and appurtenances which may in any way be a part thereof or pertain to, free and clear of
all liens and encumbrances in the following quantities:

Dedication of Improvements for Lindale Villas Condominium

Lindemann Properties II, LLC developer of Lindale Villas Condominiums has
satisfactorily completed all of the required improvements in accordance with their
developer's agreement dated February 21, 2005.
The required improvements include building a stormwater retention pond on the
east side of Martin Drive, making improvements to Martin Drive, constructing
storm sewer in Martin Drive, construction sanitary sewer within the development
and constructing water main within the development.
Attached is Lindemann Properties II request to dedicate the required improvements
which includes the total quantity and the itemized costs for each of the utility
improvements.
Recommendation for Action by Committee:
I recommend that both Finance Committee and Common Council accept the
dedication of public improvements along Martin Drive and within the Lindale Villas
Condominiums.
