COMMON COUNCIL - CITY OF MUSKEGO
RESOLUTION #100-2007
RESOLUTION SUPPORTING LRB-2103/P3, AN ACT TO CREATE 125.07 (3) (a) 3g.
OF THE WISCONSIN STATE STATUTES, RELATING TO THE PROHIBITION
AGAINST UNDERAGE PERSONS ENTERING OR BEING ON ANY PREMISES
OPERATING UNDER AN ALCOHOL BEVERAGE LICENSE
WHEREAS, The City of Muskego Finance Committee met on April 24, 2007, and is
recommending the Common Council support an Act to create 125.07 (3) (a) 3g. of the
Wisconsin State Statutes; and
WHEREAS, This proposed Act will allow for underage persons, who are not currently
allowed on the premises for which a license for the retail sale of alcohol beverages has
been issued pursuant to state law, to be on the premises if a batting cage facility with
five (5) or more indoor batting cages that are not designed for coin operation and that
measure at least 12 feet in width, 14 feet in height, and 60 feet long is present; and
WHEREAS, current state law allows similar situations for underage persons when
billiard tables, indoor golf simulators, and volleyball courts are a part of the licensed
premises, with certain stipulations.
NOW, THEREFORE BE IT RESOLVED, That the City of Muskego Common Council
recognizes no difference between the presence of an underage person on a premises
operating under an alcohol beverage license when billiard tables, indoor golf simulator,
and volleyball courts are present than when batting cages are present.
BE IT FURTHER RESOLVED, That the Common Council, upon the recommendation
of the Finance Committee, hereby supports an Act, reference LRB-21 03/P3 which is
attached to this Resolution, creating 125.07 (3) (a) 3g. of the Wisconsin State Statutes
to allow underage persons to be on the premises operating under an alcohol beverage
license if a batting cage facility with five (5) or more indoor batting cages that are not
designed for coin operation and that measure at least 12 feet in width, 14 feet in height,
and 60 feet long is present.
