WHEREAS, the Common Council of the City of ~,l1uskego, Wisconsin, held a public
hearing at the City Hall on April 11, 2006 for the purpose of hearing all interested
persons concerning the Preliminary Resolution and Fi~eport of the City Engineer on the
proposed water main improvement within thE! area de,scribed below and shown on the
attached map and heard all persons to speak at the hearing:

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of
Muskego as follows:
1. That the report of the City Engineer anel any amendments or modifications
thereto pertainin~~ to the construction of the above-described public
improvements, including plans and specifi,cations therefore is adopted and
approved.
2. That the City of Muskego has or shall advørtise for bids and shall carry out the
improvements in accordance with the mport and any amendments or
modifications thereto of the City Engineer.
3. That payment for the improvements bH made by assessing the cost to the
property benefited as indicated in tlhe report and any amendments or
modifications thereto.
4. That assessments shown on the re'port and any amendments or modifications
thereto, representing an exercise of the police power, have been determined on
a reasonable basis and are hereby confirmed.

5. The assessments shown on the report and the modifications thereto conform
with the policies of the City of Muskego now in existence as set forth in
Resolution #284..97 and amended in RI9solution #236-98 and Resolution #121-
2000, to the extent not modified by this Resolution. Pursuant to said Policy, the
City has determined the method of assessment to be a unit assessment, as set
forth in the Engineer's Report referred to tlerein and any amendments or
modifications to the same.
That the remainder of said assessments are deferred as stated in assessment
policies of the City.
6. That the assessments due pursuant to Paragraph 5 of this Resolution may be
paid in cash in full on or before November 1,2006 or in ten (10) annual
installments of pl"incipal together with twelve (12) months interest per installment
to the Clerk-Treasurer, installment payments to bear interest at the rate of 8%
per annum on the unpaid balance Gomll1encin!~ on November 1, 2006 and said
first installment being due on the date when real estate taxes are due and
annually thereof. All assessments or installments which are not paid by the date
specified shall be extended upon the tax roll as a delinquent tax against the
property and all proceedings in relation to the collection, return and sale of
property for delinquent real estate taxE3s shall apply to such special assessment,
except as other'vvise provided by statutH.
7. That all deferred assessments shall bE3ar intemst at the rate of 8% per annum on
the unpaid balance from November 1
, 2006 and until payment in full. When the
deferral of an assessment ends, said assessment shall be paid in cash in full
pursuant to the policy of the City set forth lin Resolution #284-97 and amended in
Resolution #236..98 and Resolution #121-2000, to the extent not modified by this
Resolution, unless the City, at is sole option, negotiates with a property owner
having an assessment come due an agreement by which the assessment or a
portion thereof may be further deferred when tile Common Council determines
that additional deferrals would be just and equitable under the particular
circumstances. All assessments or installments which are not paid by the date
specified shall bEl extended upon the tax roll as a delinquent tax against the
property and all proceedings in relation to the collection, return and sale of
property for delinquent real estate taxes sl1all apply to such special assessment,
except as othen/vise provided by statute.
8. Interest rates on deferred assessments may bl3 reviewed every five (5) years.
9. That the Clerk-Treasurer shall publish this Resolution as a Class 1 Notice in the
assessment district and mail a copy of this Resolution and a statement of the
final assessment against the benefitecl property to every property owner whose
name appears on the assessment roll whose post office address is known or can
with reasonable diligence be ascertainE!d.

10. Property owners may be qualified for hardship status which will allow for different
payments of the assessment. Property ovvners must apply on or before
September 1, 2006 and must be determined to qualify for said hardship status in
accordance with the assessment policy SE~t forth in Resolution #284-97 and
amended in Resolution #236-98 and R,esolution #121-2000 by October 1, 2006.

NOTICE is hereby given that a contract has been let for the installation of water
main improvements for McShane Drive frorn Durham Drive to Fairfield Drive, Water
Main Project MW-33-06, and that the amount of the special assessment for the
improvement has been determined as to each parcel of real estate affected and a
statement of the assessment is on file with the City Clerk; it is proposed to collect the
special assessment in ten (10) installments, as IProvided for by Section 66.0715 of the
Wisconsin Statutes, with interest at eight percent (8%) per year; that all assessments
will be collected in installments as proviided above except assessments on property
where the owner files with the City Clerk withiin 30 days from date of this notice a written
notice that the owner e!lects to pay the special assl3ssment on the owner's property,
describing the property, to the City TreasurE~r Oil or before the following November 1,
unless the election is revoked. If after makin~1 the el13ction, said property owner fails to
make the payment to the City Treasurer, the City Clerk shall place the entire
assessment on the following tax roll. Any deferred portion of any assessment is not
affected by this Notice.

Excerpts of Minutes of Opfn Meeting of the
Common Council of the City of Muskego
A duly-convened meeting of the Common Council of the City of Muskego, Waukesha
County, Wisconsin, was held in open session on May 23, 2006, and called to order by the Mayor
at 7:30 P.M., Central Time. The following Alderpersons were present: Eileen Madden, Eric
Schroeder, Robert Melcher, Nancy Salentine, Neil Borgman, Chris Buckmaster, Tracy Snead
The following Alderpersons were absent: None.
The Mayor opened the meeting by announcing that this was an open meeting of the
Common Council. Notice of this meeting was given to the public at least 24 hours in advance of
the meeting by forwarding the complete agenda to the official City newspaper, the Muskego Sun,
and to all news media who have requested the same as well as posting. Copies of the complete
agenda were available for inspection at the City Clerk's office. Anyone desiring information as
to forthcoming meetings should contact the CÜy Clerk's oftïce.
