RESOLUTION TO SET PUBLIC HEARING DATE FOR REZONING OF CERTAIN OLR
LAKESHORE RECREATIONAL DISTRICT PARCELS AND THE REMOVAL OF
SECTION 17: 9.08 (7) C. 4. OF THE ZONING ORDINANCE TEXT
WHEREAS, The Planning Commission has recommended that the OLR zoning district
be removed from the following parcels as the properties with the zoning do not currently
utilize the permitted uses of the OLR zoning district and the Planning Commission
believes that the many properties surrounding the lakes are residential in nature and
the removal of the OLR district is better for the community and more in lines with the
objectives and goals of the Comprehensive Plan:

WHEREAS, The Planning Commission has also recommended that the Council begin
the process to remove Section 17:9.08 (7) C. 4. of the zoning ordinance relating to a
use permitted by Conditional Use Grant:: "Multifamily use of an existing structure," as
the language is not utilized by any parcels in the City and the Planning Commission
doesn't see this use as bettering the overall community; Further, the change is more in
lines with the objectives and goals of the Comprehensive Plan; and
NOW, THEREFORE, BE IT RESOLVED BE IT RESOLVED That the Common Council
of the City of Muskego does hereby set the date of Tuesday, April 11, 2006 at 7:30
P.M. for a Public Hearing for Ule purpose of rezoning certain OLR District zoned parcels
listed above and to remove the Section 17:9.08 (7) C. 4. zoning ordinance text.

Re: OLR Lakeshore Recreational Overlay Zoning District Resolutllon

The Planning Commission has recognized that certain parcels with the OLR Lakeshore Recreational
Overlay Zoning District are not currently utilizing it. To alleviate problems with future nuisance uses to
residential neighbors the Planning Commission has recommended to Council to set a public hearing
and rezoning for a number of these OLR zoned parcels. Further, the Planning Commission has
requested that certain zoning ordinance language be removed, as they don't see it as bettering the
community. The OLR district allows "Multifamily uses of an existing structure" if a Conditional Use
Grant is received. Planning Commission doesn't see this possible use as bettering the overall
community. In addition, the conditional use grant has not been ever given to any parcels in the City.
The Plan Commission study behind this is found below:
Plan Commission directed staff at their February 21, 2006 meeting to investigate the OLR
Lakeshore Recreational District. Plan Commission specifically wanted to know what parcels are
utilizing the zoning district regulations and if there is a need for the district to continue. Also,
Planning commission wanted to know the history behind the following language in the OLR district
zoning ordinance: "Permitted Uses by Conditional Use Grant: Multifamily uses of an existing
structure. "
A map and a worksheet of the aflécted parcels are attached for relliew.
Upon investigation it was found that a total of 24 parcels have the OLR Lakeshore Recreational
Overlay zoning upon them. Of the 24 parcels, eight of those are using the guidelines of the
ordinance either directly or indirectly. By directly, staff means that the parcels have an approved
BSO or CUG based upon the permitted uses in the ordinance. By indirectly, staff means that the
parcel has a legal non-conforming use upon it that is allowed by either BSO or CUG in the
ordinance. The parcel is legal non-conforming due to the use being in place before the
implementation ofthe zoning code.

The remaining 16 parcels with the OLR zoning district are mainly used for single-family purposes
and they have had no past approvals allowing uses within the OLR district. As per Plan
Commission's direction, staff recommends that the OLR district tie removed from these 16
parcels. Plan Commission requested these changes as the properties surrounding the lakes are
residential in nature and the removal of the OLR district is better for the community and more in
lines with the objectives and goals of the Comprehensive Plan (The 2010 Comprehensive Plan
has all these parcels as slated for single-family residential).

Upon investigation of the followin'g OLR cfistrict zoning ordinance language: "Permitted Uses by
Conditional Use Grant: Multifamily uses of an existing structure," it was found that there is no
parcels that ever received approval to convert an existing structure into multi-family. The
ordinance was acfopted by Council in 1985 as a specific petitioner wanted to convert his structure
to multi-family. That petitioner never made the conversion or received a CUG. The Planning
Commission at that time actually recommended to Council to not approve this new language as
they foresaw future problems, but the Council approved it anyway.
Staff recommends as part of the resolution that the language be removed as it is not utilized by any
parcels in the City and staff doesn't see this use as bettering the overall community. Further, the
change is more in lines with the objectives and goals of the Comprehensive Plan.
