FOR LAWN MOWING SERVICES
FOR THE CITY OF MUSKEGO
BE IT RESOLVED That the Common Council of the City of Muskego does hereby
approve the attached Agreement with F & W Landscape Specialists for lawn mowing
services for 2005 and 2006.
BE IT FURTHER RESOLVED That the Mayor and Clerk-Treasurer are authorized to
sign the Agreement in the name of the City.

PUBLIC NOTICE
The City of Muskego-Parks and Recreation Department will be accepting quotes for lawn mowing services at
four sites in 2005 and 2006; (1) Bluhm Farm Park (S77W13607 McShane Drive), (2) Denoon Park
(W216S10798 Crowbar Road); (3) Manchester Hill Park (W167S7650 Parkland Drive); and (4) Muskego
Public Library (S73W16663 Janesville Road). Sites involve approximately 86 acres of turf to be mowed and
trimmed. For further information detailing the scope of this work, contact:

Minimum requirements for bidding are: firm must have a lawn maintenance contract equal to or greater
than 50 acres per site and the following minimum mowing equipment: one 10'-15' wide area mower and two
60"-72" deck mowers.
The City of Muskego reserves the right to reject any or all quotes and to waive any quoting informalities and
may acæpt the quote most advantageous to the City. .'

Mowing is to include all riding, pushing, and string trimming requirements each site demands. The athletic
field turf areas in each park is not to exceed 2" in length with the balance of the park lawn to be cut on a
weekly schedule during the growing season. *The use of any pesticides and/or plant growth regulators must
be approved by the Parks and Recreation Director and performed, if approved, by a certified pesticide
applicator. Nitrogen-based fertilizer was placed at Denoon Park and Manchester Hill Park in late fall/early
winter. Damage caused by equipment operators to turf, tree bark, plants, and park equipment (fences, signs,
benches, bleachers, etc.) will be corrected by the contractor at no cost to the City. All litter on the grounds is
to be picked up so not to be cut by a mowing unit. A usage schedule will be provided indicating the time
periods during the day when the parks are reserved for organized athletic activities or by picnic
groups. Mowing should not conflict with park users and early morning starting times will not disturb
neighbors. Park Supervisor will do walk through with contractor who is awarded 2005 & 2006 service.

INSURANCE AND INDEMNIFICATION
The contractor will carry Public Liability Insurance in the amount of $1,000,000 including protection for bodily
injury and property damage with a combined single limit of $1 ,000,000. A certificate of insurance, provided
by the City, listing the City of Muskego as liability additional insured must be filed with the City Clerk-
Treasurer.
I Contractor agrees to defend and save harmless the City of Muskego, its officers, agents and employees
against all claims, demands, payments, suits, actions, recovery and judgments of every kind and description
for personal injury or property damage brought or recovered against it by reason of any negligent action or
omission of the Contractor, its agent, or employees and with respect to the degree to which the City of
Muskego is free from negligence on the part of itself, its employees and agents.
CONSEQUENCES FOR NOT COMPLYING WITH THE SCOPE OF THE WORK
A. A substantiated case of non-compliance will be addressed to the contact person representing the
contractual service by the Parks and Recreation Director.

B. A contractor's response deemed adequate by the Parks and Recreation Director will be aCèepted and
noted should a future situation develop.
C. A contractor's response deemed inadequate by the Parks and Recreation Director will result in the
immediate termination of the contractual service.
D. If the contract is terminated, a contract will be offered to the next lowest bidder who is able to perform the
stated responsibilities in a quality manner, or a contractor designated by the Muskego Common Council.

AGREEMENT

Owner and Contractor, in consideration of the mutual covenants hereinafter set forth, agree as follows:
ARTICLE 1. SCOPE OF WORK
Contractor shall complete all Work as specified or indicated in the Contract Documents. The Work is generally
described on the proposal form as follows:

ARTICLE 2. CONTRACT PRICE
Owner shall pay Contractor for completion of the Scope of Work in accordance with the Contractor
Documents, in current funds, as follows:
$3,500.00 per month of seven months per year: May 1, 200S-Nov.
and $3,500.00 per month - May 1, 2006 ~ November 1,2006
ARTICLE 3. CONTRACT PERFORMANCE

The Work shall be completed in the manner specified in the Scope of Work or be subjected to the
consequences of non-compliance as described on page 7.

ARTICLE 5. PAYMENTS
Contractor shall submit applications for payment for process by the Director of the Parks and Recreation
Department and the Owner shall make payment accordingly.
Contractor shall submit an invoice for each payment request. Contractor shall include a mowing frequency
summary per site within the time period of said invoice.

ARTICLE 6. MISCELLANEOUS
Owner and Contractor each binds itself, its partners, successors, assigns and legal representatives in
respect of all covenants, agreements and obligations set forth in the Contract Documents.
IN WITNESS WHEREOF, Contractor and Owner have signed this Agreement in four counterparts on the
day and year first above-written.
