RESOLUTION #232-2002
APPROVAL OF QUIT CLAIM DEED BETWEEN THE
CITY OF MUSKEG0 AND PAUL J. SCHAUMBERG
WHEREAS, on May 12, 1981 per Resolution #82-81, the Common Council authorized
the Mayor & Clerk to execute documents in preparation of the Tess Corners Drainage
Project in regards to properties owned by the City and Paul and Richard Schaumberg;
and
WHEREAS, Ruekert & Mielke, Inc. had created a legal of 0.271 acres owned by the
City on April 6, 1981 that was revised on May 18, 1981 and finalized on June 25, 1981
with the intent that such lands would be quit claimed to Paul and Richard Schaumberg
along with a second legal of land consisting of 0.138 acres that was created on April 6,
1981 and finalized on April 15, 1981, and
WHEREAS, on June 26, 1981 the City Attorney was directed to prepare two quit claim
deeds to convey said lands to Paul and Richard Schaumberg; and
WHEREAS, on August 5,1981, one quit claim deed of 0.138 acres of land was
processed by the City of Muskego and duly recorded at the Waukesha County Register
of Deeds on August 6, 1981 that transferred ownership of that parcel to Paul and
Richard Schaumberg; and
WHEREAS, A recent search of the records finds no evidence that the second transfer
was finalized as intended: and
WHEREAS, The Finance Committee has recommended that said property as identified
on the attached Quit Claim Deed be transferred to Paul J. Schaumberg.
NOW, THEREFORE, BE IT RESOLVED That the Common Council of the City of
Muskego, upon the recommendation of the Finance Committee, does hereby authorize
the Mayor and Clerk to execute the attached Quit Claim Deed to transfer a part of
MSKC 2165.989.002 to Paul J. Schaumberg (Tax Key MSKC 2165.985) contingent
upon review of the documents by the City Attorney.
